The<\/span>\u00a0human rights project \u2018Political Prisoners. Memorial\u2019 considers Zarema Musaeva a political prisoner\u00a0in<\/span>\u00a0accordance with\u00a0international criteria<\/a>. Musaeva was effectively taken hostage because her sons actively criticise\u00a0the<\/span>\u00a0regime\u00a0of<\/span>\u00a0Ramzan Kadyrov, while her husband, federal judge Saidi Yangulbaev, refuses\u00a0to<\/span>\u00a0condemn their activities. Musaeva\u2019s prosecution is intended\u00a0to<\/span>\u00a0stop her sons engaging\u00a0in<\/span>\u00a0public activity and\u00a0the<\/span>\u00a0charges against her are clearly fabricated.<\/strong><\/p>\n

We demand\u00a0the<\/span>\u00a0immediate release\u00a0of<\/span>\u00a0Zarema Musaeva and that\u00a0the<\/span>\u00a0charges against her be objectively and fairly investigated.<\/strong><\/p>\n

Who is Zarema Musaeva and what are\u00a0the<\/span>\u00a0charges against her?<\/strong><\/p>\n

Zarema Musaeva is\u00a0the<\/span>\u00a0wife\u00a0of<\/span>\u00a0federal judge Saidi Yangulbaev. Their youngest son, Ibragim Yangulbaev, was administrator\u00a0of<\/span>\u00a0an opposition Telegram channel criticizing\u00a0the<\/span>\u00a0Ramzan Kadyrov regime, while their elder son, Abubakar Yangulbaev, was engaged\u00a0in<\/span>\u00a0human rights activities and worked as a lawyer\u00a0for<\/span>\u00a0the<\/span>\u00a0Committee against Torture.<\/p>\n

Most recently,\u00a0the<\/span>\u00a0Yangulbaev family – Saidi Yangulbaev, Zarema Musaeva and their daughter – had been living\u00a0in<\/span>\u00a0Nizhny Novgorod.<\/p>\n

On<\/span>\u00a0the<\/span>\u00a0evening\u00a0of<\/span>\u00a020 January 2022, Chechen law enforcement officers, with\u00a0the<\/span>\u00a0support<\/span>\u00a0of<\/span>\u00a0Nizhny Novgorod police, broke into their apartment and, unable\u00a0to<\/span>\u00a0find a pretext\u00a0for<\/span>\u00a0taking Saidi Yangulbaev\u00a0to<\/span>\u00a0Chechnya, since he has immunity as a federal judge, they took away his wife.<\/p>\n

Zarema Musaeva, who is 53-years old and suffers\u00a0from<\/span>\u00a0diabetes, was not allowed\u00a0to<\/span>\u00a0dress or take any medicines with her. She was forced into a car and driven\u00a0to<\/span>\u00a0Grozny where she was jailed\u00a0for<\/span>\u00a015 days\u00a0for<\/span>\u00a0the<\/span>\u00a0offence\u00a0of<\/span>\u00a0\u2018petty hooliganism\u2019\u00a0on<\/span>\u00a0the<\/span>\u00a0grounds that she allegedly swore when arrested.<\/p>\n

Subsequently, a criminal charge was laid against Musaeva\u00a0for<\/span>\u00a0using force against a police officer (Article 318, Part 2,\u00a0of<\/span>\u00a0the<\/span>\u00a0Russian Criminal Code).\u00a0The<\/span>\u00a0Investigative Committee claimed she had assaulted a police officer when he was writing up\u00a0the<\/span>\u00a0administrative charge sheet.<\/p>\n

In<\/span>\u00a0addition, Musaeva has been charged with fraud (Article 159, Part 3,\u00a0of<\/span>\u00a0the<\/span>\u00a0Russian Criminal Code )\u00a0in<\/span>\u00a0connection with a criminal investigation opened\u00a0in<\/span>\u00a0Chechnya back\u00a0in<\/span>\u00a02019. At that time, Musaeva and her husband had already been living outside\u00a0the<\/span>\u00a0Chechen Republic\u00a0for<\/span>\u00a0two years. Her lawyers have yet\u00a0to<\/span>\u00a0be allowed\u00a0to<\/span>\u00a0review\u00a0the<\/span>\u00a0case file.<\/p>\n

Lawyers\u00a0from<\/span>\u00a0the<\/span>\u00a0Committee against Torture, who have taken\u00a0on<\/span>\u00a0Musaeva\u2019s case, have already filed dozens\u00a0of<\/span>\u00a0petitions, complaints and appeals against\u00a0the<\/span>\u00a0actions\u00a0of<\/span>\u00a0law enforcement officials, but\u00a0the<\/span>\u00a0Chechen and Nizhny Novgorod authorities have sabotaged\u00a0the<\/span>\u00a0proceedings.<\/p>\n

Immediately after Musaeva’s abduction,\u00a0the<\/span>\u00a0European Court\u00a0of<\/span>\u00a0Human Rights demanded that\u00a0the<\/span>\u00a0Russian authorities ensure her safety under Rule 39.\u00a0The<\/span>\u00a0European Union,\u00a0the<\/span>\u00a0US State Department and Amnesty International have all called\u00a0for<\/span>\u00a0Musaeva’s release.\u00a0The<\/span>\u00a0head\u00a0of<\/span>\u00a0the<\/span>\u00a0Presidential Human Rights Council, Valery Fadeyev, has requested that her criminal case be transferred\u00a0from<\/span>\u00a0Chechnya\u00a0to<\/span>\u00a0the<\/span>\u00a0Investigative Committee’s division\u00a0for<\/span>\u00a0the<\/span>\u00a0North Caucasus Federal District or\u00a0to<\/span>\u00a0the<\/span>\u00a0Investigative Committee\u2019s federal headquarters\u00a0in<\/span>\u00a0Moscow.<\/p>\n

Why do we consider Musaeva a political prisoner?<\/strong><\/p>\n

We consider\u00a0the<\/span>\u00a0abduction and criminal prosecution\u00a0of<\/span>\u00a0Zarema Musaeva are linked\u00a0to<\/span>\u00a0the<\/span>\u00a0opposition and human rights activities\u00a0of<\/span>\u00a0her sons Abubakar and Ibragim Yangulbaev.<\/p>\n

Ibragim Yangulbaev was detained twice by Chechen security forces –\u00a0in<\/span>\u00a02015 and\u00a0in<\/span>\u00a02017. He was held\u00a0in<\/span>\u00a0a secret prison\u00a0in<\/span>\u00a0Grozny and tortured because he had been running an opposition Telegram channel.<\/p>\n

His father, federal judge Saidi Yangulbaev, was forced\u00a0to<\/span>\u00a0resign after he refused\u00a0to<\/span>\u00a0publicly condemn and physically strike his son.<\/p>\n

At\u00a0the<\/span>\u00a0end\u00a0of<\/span>\u00a02020,\u00a0the<\/span>\u00a0situation\u00a0of<\/span>\u00a0the<\/span>\u00a0Yangulbaev family again became more difficult.\u00a0The<\/span>\u00a0Yangulbaev brothers were accused\u00a0of<\/span>\u00a0being involved\u00a0in<\/span>\u00a0running\u00a0the<\/span>\u00a0opposition\u00a01ADAT<\/a>\u00a0Telegram channel. Ibragim and his younger brother Baisangur Yangulbaev left Russia, while\u00a0the<\/span>\u00a0rest\u00a0of<\/span>\u00a0the<\/span>\u00a0family left Chechnya. Family members who remained\u00a0in<\/span>\u00a0the<\/span>\u00a0country began receiving death threats;\u00a0the<\/span>\u00a0female family members also received threats that they would be raped.<\/p>\n

After Zarema Musaeva was abducted, a campaign against\u00a0the<\/span>\u00a0entire Yangulbaev family was launched\u00a0in<\/span>\u00a0Chechnya. Ramzan Kadyrov publicly called them enemies\u00a0of<\/span>\u00a0Chechnya and terrorists and stated that\u00a0\u2018their place is either\u00a0in<\/span>\u00a0prison or underground.\u2019\u00a0<\/em>He openly called upon\u00a0the<\/span>\u00a0Yangulbaev brothers who had left Russia\u00a0to<\/span>\u00a0return and\u00a0\u2018free their mother.\u2019\u00a0<\/em>Similar statements were made by other leading Chechen officials.\u00a0The<\/span>\u00a0Yangulbaevs‘ relatives\u00a0in<\/span>\u00a0Chechnya were repeatedly detained.<\/p>\n

We believe Zarema Musaeva is\u00a0in<\/span>\u00a0effect a hostage\u00a0of<\/span>\u00a0Ramzan Kadyrov. Her abduction fits\u00a0in<\/span>\u00a0with\u00a0the<\/span>\u00a0routine practices\u00a0of<\/span>\u00a0the<\/span>\u00a0Chechen security services.<\/p>\n
