Memorial Human Rights Centre, in\u00a0accordance with\u00a0international guidelines<\/a>, considers Emil Ziyadinov a\u00a0political prisoner. We\u00a0believe he\u00a0is\u00a0being prosecuted for the non-violent exercise of\u00a0freedom of\u00a0religion and the right of\u00a0association. So\u00a0far as\u00a0we\u00a0know, Ziyadinov has been deprived of\u00a0his liberty in\u00a0the absence of\u00a0any evidence of\u00a0a\u00a0crime in\u00a0order to\u00a0put an\u00a0end to\u00a0his religious activities, as\u00a0well as\u00a0to\u00a0suppress civic activity among the residents of\u00a0Crimea following annexation.<\/p>\n

Who is\u00a0Emil Ziyadinov and what are the charges against him?<\/strong><\/p>\n

Emil Ziyadinov, 37, is\u00a0an\u00a0activist of\u00a0Crimean Solidarity, the Crimean Tatar human rights movement. He\u00a0has repeatedly participated in\u00a0solidarity actions for political prisoners, including in\u00a0Moscow, and provided support to\u00a0their families.<\/p>\n

On\u00a07 July 2020 law enforcement agents searched the homes of\u00a0Crimean Tatars across the peninsula. Emil Ziyadinov was one of\u00a0six Crimeans detained and then remanded in\u00a0custody.<\/p>\n

Ziyadinov is\u00a0accused of\u00a0organising, in\u00a0the Crimean village of\u00a0Oktyabrsky, a\u00a0cell of\u00a0the Islamic Liberation Party (Hizb ut-Tahrir al-Islami), which has been designated a\u00a0terrorist organisation in\u00a0Russia (under Article 205.5, Part\u00a01, of\u00a0the Russian Criminal Code).<\/p>\n

As\u00a0a\u00a0member of\u00a0this organisation, Ziyadinov has been charged with preparing a\u00a0seizure of\u00a0power (Article\u00a030, Part\u00a01, in\u00a0association with Article 278 of\u00a0the Russian Criminal Code). The Investigative Committee justified this charge on\u00a0the grounds that the declared goal of\u00a0Hizb ut-Tahrir is\u00a0to\u00a0create a\u00a0worldwide Islamic Caliphate, which would include the Muslim regions of\u00a0the world.<\/p>\n

Ziyadinov\u2019s trial began at\u00a0the Southern District Military Court in\u00a0Rostov-on-Don in\u00a0April 2021.<\/p>\n

Emil Ziyadinov maintains his innocence of\u00a0the charges.<\/p>\n

Why Memorial considers Ziyadinov a\u00a0political prisoner<\/strong><\/p>\n

According to\u00a0the investigators themselves, Ziyadinov is\u00a0guilty of\u00a0nothing more than being a\u00a0member of\u00a0a\u00a0religious association.<\/p>\n

As\u00a0in\u00a0other prosecutions for involvement in\u00a0Hizb ut-Tahrir known to\u00a0us, the defendant in\u00a0this case has not been charged with preparing to\u00a0commit an\u00a0act of\u00a0terrorism or\u00a0making terrorist threats. As\u00a0can be\u00a0seen from the experts\u2019 examination of\u00a0the audio recordings of\u00a0the four meetings included in\u00a0the indictment, only one person other than Ziyadinov took part in\u00a0them, and that person has not been identified by\u00a0the investigation. On\u00a0the basis of\u00a0these conversations, the experts decided that the accused behaved as\u00a0a \u2018teacher\u2019 or \u2018mentor\u2019 while the second participant in\u00a0the conversations acted as\u00a0a \u2018student\u2019. The mentor and student were reading and discussing texts from the \u2018ideological sources\u2019 of\u00a0Hizb ut-Tahrir. This, according to\u00a0the investigators, constitutes \u2018terrorist activity\u2019.<\/p>\n

Memorial considers the designation of\u00a0Hizb ut-Tahrir as\u00a0a\u00a0terrorist organization to\u00a0have no\u00a0basis in\u00a0fact or\u00a0law. The Supreme Court decision of\u00a02003 devotes one paragraph of\u00a0three sentences to\u00a0Hizb ut-Tahrir. These three sentences contain no\u00a0evidence of\u00a0terrorist activities.<\/p>\n

We\u00a0note that Article 28\u00a0of\u00a0the Russian Constitution guarantees everyone \u2018freedom of\u00a0conscience and freedom of\u00a0religious belief, including the right to\u00a0profess, individually or\u00a0together with others, any religion or\u00a0to\u00a0profess no\u00a0religion, to\u00a0freely choose, have and disseminate religious and other beliefs and act in\u00a0accordance with them.\u2019<\/p>\n

In\u00a0the years since Hizb ut-Tahrir was designated a\u00a0terrorist organisation in\u00a0the Russian Federation, hundreds of\u00a0Muslims have been prosecuted on\u00a0criminal charges for involvement in\u00a0the organisation. Each successive year courts have sentenced believers to\u00a0ever longer prison terms (up\u00a0to\u00a024\u00a0years). At\u00a0present, more than 330 people have been convicted or\u00a0are being prosecuted for involvement in\u00a0Hizb ut-Tahrir.<\/p>\n

The unjust and unlawful prosecutions of\u00a0Muslims for involvement in\u00a0Hizb ut-Tahrir is\u00a0exacerbated in\u00a0the Crimea by\u00a0the fact that under Ukrainian law this organisation operated legally.<\/p>\n

Emil Ziyadinov was an\u00a0active participant in\u00a0the Crimean Solidarity human rights movement, providing support to\u00a0Crimean Tatar political prisoners and their families. We\u00a0believe prosecution for involvement in\u00a0Hizb ut-Tahrir has become a\u00a0means to\u00a0suppress solidarity among the residents of\u00a0Crimea.<\/p>\n
