We\u00a0believe that they have been remanded in\u00a0custody for the non-violent exercise of\u00a0their rights to\u00a0freedom of\u00a0religion and freedom of\u00a0association.<\/p>\n<p>Memorial calls for all the charges against the defendants to\u00a0be\u00a0dropped immediately and for those unjustifiably held in\u00a0custody to\u00a0be\u00a0released.<\/p>\n<p><strong>Who are the four and what are the charges against them?<\/strong><\/p>\n<p>The four Crimean Tatars were\u00a0<a href=\"https:\/\/memohrc.us6.list-manage.com\/track\/click?u=0beb3097c1&amp;id=bed1a492a7&amp;e=339ca062ef\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/memohrc.us6.list-manage.com\/track\/click?u%3D0beb3097c1%26id%3Dbed1a492a7%26e%3D339ca062ef&amp;source=gmail&amp;ust=1630425955930000&amp;usg=AFQjCNEyX_qPXC8QM_3nUhtato3_47dhKg\">arrested<\/a>\u00a0on\u00a011\u00a0March 2020 in\u00a0their homes in\u00a0the Bakhchisaray district of\u00a0Crimea. A\u00a0fifth\u00a0\u2014 S.\u00a0V. Seitumerov\u00a0\u2014 was not detained because he\u00a0lives in\u00a0Kiev.<\/p>\n<p>According to\u00a0the FSB, S. Sh. Seitumerov and S.\u00a0V.\u00a0Seitumerov set up\u00a0a\u00a0cell of\u00a0the international organisation Hizb ut-Tahrir al-Islami (Party of\u00a0Islamic Liberation, banned as\u00a0terrorist in\u00a0Russia) in\u00a0Bakhchisaray and involved local Muslims in\u00a0its work, namely Osman Seitumerov, Rustem Seitmemetov and Amet Suleimanov. The organisers of\u00a0the cell allegedly conducted conspiratorial studies of\u00a0the ideology of\u00a0Hizb ut-Tahrir and thereafter promoted these ideas among their fellow countrymen. The men have been charged with offences under Article 205.5 of\u00a0the Russian Criminal Code (organisation of\u00a0the activities of\u00a0a\u00a0terrorist organisation and participation in\u00a0it).<\/p>\n<p>The FSB also discovered that the Bakhchisaray residents desired in\u00a0the future to \u2018create an\u00a0ideal Muslim state (the global Islamic Caliphate)\u2019 and in\u00a0addition charged them with \u2018preparation for the forcible seizure of\u00a0power by\u00a0an\u00a0organised group\u2019 (Article\u00a030, Part\u00a01, in\u00a0conjunction with Article 278, of\u00a0the Russian Criminal Code).<\/p>\n<p>In\u00a0January 2021 the trial began of\u00a0the four defendants held in\u00a0custody at\u00a0the Southern District Military Court in\u00a0Rostov-on-Don. S.\u00a0V.\u00a0Seitumerov\u2019s case was separated out from that of\u00a0the others and not submitted to\u00a0the court on\u00a0account of\u00a0his wanted status.<\/p>\n<p><strong>Why does Memorial consider the prosecutions politically motivated?<\/strong><\/p>\n<p>The investigators consider the Muslims who are being prosecuted guilty only because they are members of\u00a0a\u00a0public religious association. The defendants were not charged with preparing terrorist attacks or\u00a0making terrorist threats.<\/p>\n<p>Memorial considers the designation of\u00a0Hizb ut-Tahrir as\u00a0a\u00a0terrorist organisation to\u00a0be\u00a0unlawful. The 2003 Supreme Court decision contains no\u00a0evidence of\u00a0terrorist activities by\u00a0the organisation.<\/p>\n<p>In\u00a0the years since Hizb ut-Tahrir was declared a\u00a0terrorist organisation in\u00a0the Russian Federation, hundreds of\u00a0Muslims have been prosecuted on\u00a0criminal charges related to\u00a0involvement in\u00a0the organisation. With each year, the courts sentence believers to\u00a0ever longer terms of\u00a0imprisonment (up\u00a0to\u00a024\u00a0years in\u00a0a\u00a0strict regime penal colony). More than 300 people are currently being\u00a0<a href=\"https:\/\/memohrc.us6.list-manage.com\/track\/click?u=0beb3097c1&amp;id=2e5b39ce53&amp;e=339ca062ef\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/memohrc.us6.list-manage.com\/track\/click?u%3D0beb3097c1%26id%3D2e5b39ce53%26e%3D339ca062ef&amp;source=gmail&amp;ust=1630425955930000&amp;usg=AFQjCNEftiLamV5pm62l_BzuOmtWhCEkmg\">prosecuted<\/a>\u00a0on\u00a0charges of\u00a0involvement in\u00a0the religious organisation.<\/p>\n<p>The unfairness and unlawfulness of\u00a0the prosecution of\u00a0Muslims charged with involvement in\u00a0Hizb ut-Tahrir in\u00a0Crimea today is\u00a0exacerbated by\u00a0the fact that under Ukrainian law the organisation is\u00a0legal.<\/p>\n<p>Most of\u00a0the accused had taken part in\u00a0supporting Crimean Tatars who were political prisoners and their families within the framework of\u00a0the Crimean Solidarity human rights movement. The accusation of\u00a0involvement in\u00a0Hizb ut-Tahrir has become a\u00a0means to\u00a0suppress the public solidarity of\u00a0Crimean residents.<\/p>\n<p><em>Recognition of\u00a0an\u00a0individual as\u00a0a\u00a0political prisoner or\u00a0as\u00a0a\u00a0victim of\u00a0politically motivated prosecution does not imply Memorial Human Rights Centre agrees with, or\u00a0approves\u00a0of, their
