Memorial Human Rights Centre, in\u00a0accordance with\u00a0international guidelines<\/a>, considers Rais Gimadiev a\u00a0political prisoner. We\u00a0believe Gimadiev\u2019s imprisonment is\u00a0politically motivated and is\u00a0on\u00a0account of\u00a0his religious beliefs and the non-violent exercise of\u00a0freedom of\u00a0expression, religion, peaceful assembly and association guaranteed by\u00a0the Russian Constitution and the International Covenant on\u00a0Civil and Political Rights, as\u00a0well as\u00a0the European Convention on\u00a0Human Rights.<\/p>\n

Memorial Human Rights Centre calls for the immediate release of\u00a0Rais Gimadiev and a\u00a0review of\u00a0his conviction.<\/p>\n

Who is\u00a0Rais Gimadiev and what were the charges against him?<\/strong><\/p>\n

Rais Gimadiev, 41, lived in\u00a0Naberezhnye Chelny in\u00a0Tatarstan. He\u00a0had previously been prosecuted in\u00a02007 and 2011\u00a0on charges of\u00a0organising and participating in\u00a0the activities of\u00a0an\u00a0extremist organisation (Article 282.2, Parts 1\u00a0and\u00a02, of\u00a0the Russian Criminal Code).<\/p>\n

In\u00a0October 2018, Gimadiev was again arrested. On\u00a013 May 2020 the Central District Military Court in\u00a0Ekaterinburg found him guilty of\u00a0organising the activities of\u00a0a\u00a0terrorist organisation (Article 205.5, Part\u00a01, of\u00a0the Russian Criminal Code) and publicly justifying terrorism on\u00a0the internet (Article 205.2, Part\u00a02, of\u00a0the Russian Criminal Code). He\u00a0was sentenced to\u00a016\u00a0years\u2019 imprisonment in\u00a0a\u00a0strict regime penal colony.<\/p>\n

According to\u00a0the court\u2019s verdict, Gimadiev was one of\u00a0the leaders of\u00a0Hizb ut-Tahrir al-Islami (the Islamic Liberation Party, banned in\u00a0the Russian Federation as\u00a0a\u00a0terrorist organisation). The prosecution alleged he\u00a0was responsible for setting up\u00a0at\u00a0least one clandestine cell of\u00a0the organisation in\u00a0Tatarstan and for persuading people to\u00a0join the party by\u00a0leading them into \u2018religious error.\u2019 He\u00a0also allegedly provided support to\u00a0a\u00a0convicted member of\u00a0the organisation and posted on\u00a0his Facebook page justifications for party members\u2019 terrorist activities.<\/p>\n

Gimadiev pleaded not guilty and argued he\u00a0was being criminally prosecuted because of\u00a0his religious beliefs.<\/p>\n

Why do\u00a0we\u00a0consider him a\u00a0political prisoner?<\/strong><\/p>\n

Memorial Human Rights Centre concluded Gimadiev was wrongly convicted because he\u00a0had not been charged with preparing or\u00a0carrying out a\u00a0terrorist attack, making terrorist threats or\u00a0inciting violence. He\u00a0was charged only with organising meetings at\u00a0which Hizb ut-Tahrir literature was read and discussed, as\u00a0well as\u00a0with persuading other people to\u00a0attend the meetings.<\/p>\n

Memorial considers the 2003 decision of\u00a0the Supreme Court designating Hizb ut-Tahri al-Islami a\u00a0terrorist organisation unlawful since the decision contains no\u00a0evidence of\u00a0terrorist activities on\u00a0the part of\u00a0the organisation.<\/p>\n

In\u00a0our assessment, the trial did not even prove that Gimadiev had involved other people in\u00a0the organisation\u2019s activities.<\/p>\n

The testimony of\u00a0a\u00a0key witness, Erik Karmatsky, also raises doubts. He\u00a0claimed Gimadiev had persuaded him to\u00a0adopt Hizb ut-Tahrir beliefs, although by\u00a0then he\u00a0had already been a\u00a0member of\u00a0the organisation for a\u00a0long time, had been convicted and was serving his sentence. Karmatsky was probably cooperating with the FSB. In\u00a02017 Karmatsky was given just three years\u2019 imprisonment on\u00a0charges of\u00a0taking part in\u00a0the activities of\u00a0a\u00a0terrorist organisation (Article 205.5, Part\u00a02, of\u00a0the Russian Criminal Code, which prescribes a\u00a0penalty from 10\u00a0to\u00a020\u00a0years in\u00a0prison). During his time in\u00a0prison, Karmatsky was a\u00a0prosecution witness in\u00a0the case of\u00a0another person convicted of\u00a0belonging to\u00a0Hizb ut-Tahrir, Ramil Gataullin, whom Memorial also\u00a0considers a\u00a0political prisoner<\/a>.<\/p>\n

Other witnesses for the prosecution changed their testimony at\u00a0the trial, stating that their original testimonies had been given under the influence of\u00a0FSB officers.<\/p>\n

Gimadiev also promised to\u00a0provide material assistance (5,000\u00a0roubles) to\u00a0a\u00a0convict serving a\u00a0sentence for membership in\u00a0Hizb ut-Tahrir, something the court also considered a\u00a0crime.<\/p>\n
