At\u00a0the end of\u00a0May 2021 there were two landmark events regarding application of\u00a0the legislation on \u2018undesirable organisations.\u2019 On\u00a026 May three German NGOs\u00a0\u2014 Forum Russischsprachiger Europ\u00e4er [Forum of\u00a0Russian-speaking Europeans], Zentrum f\u00fcr die Liberale Moderne [Centre for Liberal Modernity] and Deutsch-Russischer Austausch [German-Russian Exchange]\u00a0\u2014 were declared \u2018undesirable.\u2019 Following this, other German NGOs declared they could no\u00a0longer participate in\u00a0the St\u00a0Petersburg Dialogue, a\u00a0civil society forum of\u00a0the two countries that has been held in\u00a0the city for many years. On\u00a031\u00a0May, Andrei Pivovarov, former director of\u00a0Open Russia, was removed from a\u00a0plane that was already on\u00a0the runway at\u00a0St\u00a0Petersburg\u2019s Pulkovo airport and remanded in\u00a0custody for involvement in\u00a0the activities of\u00a0an \u2019undesirable organisation\u2019. These arbitrary and blatantly unlawful actions are based on\u00a0existing legislation about \u2018undesirable organisations.\u2019 Meanwhile, on\u00a018\u00a0May the State Duma adopted in\u00a0first reading two amendments to\u00a0this legislation which significantly expand and tighten its repressive provisions.<\/p>\n

The first amendment amends\u00a0the Federal Law \u2018On Measures to\u00a0Influence Persons Involved in\u00a0Violations of\u00a0Fundamental Human Rights and Freedoms, the Rights and Freedoms of\u00a0Citizens of\u00a0the Russian Federation\u2019<\/a>\u00a0to\u00a0prohibit the participation of\u00a0Russian citizens and legal entities in\u00a0the activities of \u2018undesirable organisations\u2019 not only on\u00a0the territory of\u00a0Russia, but also beyond its borders.<\/p>\n

The second amends\u00a0Article 284.1 of\u00a0the Criminal Code of\u00a0the Russian Federation<\/a>, extending criminal liability for \u2018carrying out the activities\u2019 of\u00a0an \u2018undesirable organisation\u2019 outside the country and making it\u00a0easier to\u00a0prosecute under this Article. Currently, it\u00a0is\u00a0possible to\u00a0prosecute a\u00a0person under Article 284.1 where they have been held liable on\u00a0two occasions on\u00a0similar charges under administrative law in\u00a0the preceding 12\u00a0months. The amendments would make it\u00a0possible to\u00a0prosecute \u2018participants\u2019 in\u00a0the activities of\u00a0an \u2018undesirable organisation\u2019 after a\u00a0single administrative conviction for a\u00a0similar offence, and those declared to\u00a0be\u00a0leaders of\u00a0such organisations to\u00a0be\u00a0prosecuted with no\u00a0such prior conviction.<\/p>\n

\nThe list of \u2018undesirable\u2019 organisations, numbering 33\u00a0as of\u00a0the beginning of\u00a0June 2021, includes internationally recognised and respected human rights, educational and research organisations which pose no\u00a0threat to\u00a0Russian interests.<\/p>\n

The very notion of \u2018undesirable\u2019 organisations is\u00a0perverse since it\u00a0knowingly implies arbitrariness on\u00a0the part of\u00a0state authorities. This was pointed out by\u00a0the Venice Commission in\u00a0its 2016\u00a0opinion<\/a>. The threats to\u00a0the \u2018foundations of\u00a0the constitutional order of\u00a0the Russian Federation, the country\u2019s defence capability or\u00a0state security\u2019 allegedly posed by\u00a0those organisations recognised as \u2018undesirable\u2019 are abstract and unacceptably broad, as\u00a0they lack the legal certainty necessary under law.<\/p>\n

The procedure for declaring an\u00a0organisation \u2018undesirable\u2019 by\u00a0decision of\u00a0the Prosecutor General\u2019s Office without any need to\u00a0provide reasoning is\u00a0arbitrary in\u00a0nature. The possibility of\u00a0a\u00a0judicial challenge to\u00a0the decision taken in\u00a0this way is\u00a0a\u00a0sham, since the court accepts without question operational reports by\u00a0the FSB (as\u00a0was the case with the American Free Russia Foundation) that contain neither a\u00a0description of\u00a0the essence of\u00a0the alleged threats nor any concrete evidence of\u00a0them.<\/p>\n

As\u00a0we\u00a0see in\u00a0all criminal cases under Article 284.1 of\u00a0the Criminal Code (until now initiated solely on\u00a0charges of\u00a0participation in\u00a0the Open Russia public movement, which even under the draconian Russian law cannot be\u00a0considered \u2018undesirable\u2019 and has never been recognised as\u00a0such), absolutely lawful actions in\u00a0exercise of\u00a0the constitutional rights and freedoms of\u00a0Russian citizens are treated as\u00a0evidence of \u2018participation in\u00a0activities\u2019: freedom of\u00a0speech and the rights of\u00a0assembly and association and the management of\u00a0property. The egregious lawlessness of\u00a0criminal prosecutions under the law on\u00a0undesirable organisation can be\u00a0seen in\u00a0the cases of\u00a0Anastasia Shevchenko<\/a>,\u00a0Yana Antonova<\/a>,\u00a0Mikhail Iosilevich<\/a>\u00a0and others. Andrei Pivovarov and Yury Sidorov have now been added to\u00a0their ranks.<\/p>\n

\nThe authorities are now preparing to\u00a0penalise involvement in \u2018undesirable organisations\u2019 beyond Russia\u2019s borders. The evidence in\u00a0such cases will inevitably be\u00a0based solely on\u00a0operational and intelligence information that\u00a0is, in\u00a0principle, unverifiable. By\u00a0simplifying criminal prosecution procedures, the authorities will inevitably expand repressive measures against human rights defenders, journalists and civic activists (primarily, but by\u00a0no\u00a0means limited\u00a0to, those associated with Open Russia and Mikhail Khodorkovsky).<\/p>\n

We\u00a0demand that the Russian authorities respect the Constitution and our country\u2019s international obligations, abandon the amendments to\u00a0the legislation on \u2018undesirable organisations\u2019 and implement the recommendations of\u00a0the Venice Commission regarding this legislation.<\/p>\n

We\u00a0call on\u00a0Russian citizens and international organisations and authorities as\u00a0well as\u00a0civil society representatives from other countries to\u00a0put pressure on\u00a0the Russian authorities to\u00a0implement these demands.<\/p>\n","protected":false},"excerpt":{"rendered":"
