Memorial Human Rights Centre, in\u00a0accordance with\u00a0international guidelines<\/a>, considers Aleksandr Shestun, former head of\u00a0the Serpukhov district in\u00a0Moscow Region, a\u00a0political prisoner. We\u00a0believe he\u00a0is\u00a0being prosecuted for his political beliefs and that he\u00a0has been imprisoned in\u00a0violation of\u00a0his right to\u00a0a\u00a0fair trial.<\/p>\n

We\u00a0demand an\u00a0immediate review of\u00a0the measures and court decisions taken against him.<\/p>\n

Who is\u00a0Aleksandr Shestun and what are the charges against him?<\/strong><\/p>\n

From 2003 until his arrest on\u00a013\u00a0June 2018 Aleksandr Shestun was head of\u00a0the Serpukhov district in\u00a0Moscow Region.<\/p>\n

Criminal proceedings were initiated against Shestun and he\u00a0was remanded in\u00a0custody after he\u00a0made a\u00a0number of\u00a0public statements, including the announcement of\u00a0his intention to\u00a0stand for reelection as\u00a0head of\u00a0the district, criticism of\u00a0the administrative reform of\u00a0Moscow Region and his decision to\u00a0grant permission for a\u00a0rally to\u00a0be\u00a0held against the Lesnaya landfill. Shestun also published an\u00a0open letter to\u00a0President Vladimir Putin together with audio recordings of\u00a0threats made to\u00a0him by\u00a0top officials from the presidential administration, the FSB and the Moscow Region governor\u2019s office promising to\u00a0institute criminal proceedings against him if\u00a0he\u00a0refused to\u00a0write a\u00a0letter of\u00a0resignation.<\/p>\n

He\u00a0was charged with offences under four articles of\u00a0the Russian Criminal Code:<\/p>\n

\u2014\u00a0Article 159, Part\u00a04 (fraud);
\n\u2014\u00a0Article 174.1, Part\u00a04, Para \u2018b\u2019 (legalization of\u00a0illegally obtained property);
\n\u2014\u00a0Article 289 (illegal participation in\u00a0entrepreneurial activities);
\n\u2014\u00a0Article 290, Part\u00a06 (receiving bribes on\u00a0a\u00a0specially large scale).<\/p>\n

On\u00a021 December 2020 Podolsky town court in\u00a0Moscow Region found Shestun guilty on\u00a0all four counts and sentenced him to\u00a015\u00a0years in\u00a0a\u00a0strict regime penal colony with a\u00a0fine of\u00a049.5 million roubles. In\u00a0addition, the court ruled in\u00a0favour of\u00a0a\u00a0civil claim against Shestun by\u00a0the local government of\u00a0Serpukhov municipal district to\u00a0the amount of\u00a064.5 million roubles.<\/p>\n

Shestun maintained his innocence of\u00a0all charges.<\/p>\n

In\u00a02019\u20132020 the courts also ruled in\u00a0favour of\u00a0two civil suits brought by\u00a0the Prosecutor General\u2019s Office of\u00a0the Russian Federation, under which all property was seized from Shestun and his family.<\/p>\n

Why does Memorial consider Shestun\u2019s prosecution and conviction politically motivated?<\/strong><\/p>\n

Memorial Human Rights Centre believes Aleksandr Shestun has been imprisoned for political reasons, namely to\u00a0prevent him participating in\u00a0local elections and, at\u00a0the same time, to\u00a0demonstratively punish someone for daring to\u00a0make public threats they had received from senior officials.<\/p>\n

These officials included governor of\u00a0the Moscow Region Andrei Vorobiev, head of\u00a0the presidential administration\u2019s domestic affairs directorate Andrei Yarin, head of\u00a0the administration of\u00a0the Moscow Region governor Mikhail Kuznetsov and FSB general Ivan Tkachev. It\u00a0is\u00a0indicative that none of\u00a0these individuals denied the authenticity of\u00a0the materials published by\u00a0Shestun.<\/p>\n

Analysis of\u00a0the case materials leads\u00a0us to\u00a0conclude that Shestun did not have a\u00a0fair trial. Some of\u00a0the evidence used to\u00a0convict him was obtained by\u00a0means of\u00a0intimidation of\u00a0witnesses in\u00a0violation of\u00a0Article 6\u00a0of\u00a0the European Human Rights Convention. The overwhelming majority of\u00a0the charges against Shestun were not proven in\u00a0court.<\/p>\n

The right to\u00a0a\u00a0fair trial was also violated during the civil lawsuits brought against Shestun by\u00a0the General Prosecutor\u2019s Office.<\/p>\n

Instead of\u00a0a\u00a0showcase anti-corruption prosecution, we\u00a0have seen a\u00a0political show trial. The message broadcast from the very top of\u00a0the Russian government is\u00a0not that those in\u00a0official positions should not break the law, but that they should not publicly clash with officials who are more powerful than them.<\/p>\n
