Memorial Human Rights Centre considers Valery Yevsin a\u00a0political prisoner, in\u00a0accordance with\u00a0international guidelines<\/a>\u00a0defining the term. We\u00a0believe he\u00a0has been prosecuted for exercising the rights to\u00a0freedom of\u00a0expression and assembly. We\u00a0consider Yevsin\u2019s criminal prosecution politically motivated and the sentence he\u00a0has been given unjustifiably severe and intended to\u00a0intimidate those bold enough to\u00a0take part in\u00a0political protests.<\/p>\n

Memorial demands the immediate release of\u00a0Valery Yevsin and a\u00a0review of\u00a0the judgment in\u00a0his case.<\/p>\n

Who is\u00a0Valery Yevsin and what are the charges against him?<\/strong><\/p>\n

On\u00a023 January Yevsin took part in\u00a0a\u00a0Moscow protest in\u00a0support of\u00a0opposition politician Aleksei Navalny. According to\u00a0the investigators, on\u00a0Strastnoy Boulevard Yevsin pushed a\u00a0metal barrier towards a\u00a0police officer. In\u00a0so\u00a0doing, he\u00a0allegedly struck the police officer \u2018at least one blow\u2019 in\u00a0the region of\u00a0the stomach and chest and \u2018caused him physical pain, moral suffering and also harmed his honour and dignity and undermined the authority of\u00a0the victim as\u00a0a\u00a0public official.\u2019<\/p>\n

Yevsin was arrested on\u00a029\u00a0January. He\u00a0made a\u00a0full admission of\u00a0guilt. Yevsin said he\u00a0had decided to\u00a0intervene on\u00a0behalf of\u00a0a\u00a0minor who had been detained, but did not want to\u00a0cause the police officer physical harm or\u00a0insult him.<\/p>\n

Yevsin\u2019s case was heard in\u00a0a\u00a0special procedure. The court took into account his admission of\u00a0guilt and the apologies expressed to\u00a0the police officer, and also the fact that Yevsin has two very young dependents.<\/p>\n

Nonetheless, on\u00a07\u00a0April Moscow\u2019s Tverskoy district court found Valery Yevsin guilty of\u00a0using force against a\u00a0public official (Article 318, Part\u00a01, of\u00a0the Russian Criminal Code) and sentenced him to\u00a0two years in\u00a0a\u00a0general-regime penal colony.<\/p>\n

Why Memorial considers Valery Yevsin a\u00a0political prisoner<\/strong><\/p>\n

While Yevsin\u2019s actions constitute evidence of\u00a0a\u00a0crime under Article 318 of\u00a0the Russian Criminal Code, we\u00a0believe it\u00a0is\u00a0important to\u00a0consider the context of\u00a0what happened and also the reaction to\u00a0his actions by\u00a0the law enforcement and judicial systems.<\/p>\n

Yevsin took part in\u00a0a\u00a0peaceful protest that was a\u00a0legitimate expression of\u00a0public outrage at\u00a0the authorities\u2019 actions. Nonetheless, the law enforcement agents used force en\u00a0masse against participants in\u00a0the protest.<\/p>\n

The police officer identified as\u00a0the victim in\u00a0Yevsin\u2019s case declared that he \u2018felt pain\u2019 from the push. At\u00a0the same time, the officer in\u00a0question was wearing complete body armour and did not suffer any physical injuries.<\/p>\n

The same day officers from the police force and the National Guard caused serious injuries to\u00a0dozens of\u00a0protesters, but have gone unpunished despite the fact that their actions were recorded on\u00a0photos and videos and the protesters\u2019 injuries have been confirmed by\u00a0medical records.<\/p>\n

We\u00a0consider that such a\u00a0selective use of\u00a0criminal prosecution is\u00a0evidence of\u00a0a\u00a0clear bias on\u00a0the part of\u00a0the Russian authorities.<\/p>\n

Moreover, the bias of\u00a0the judicial system in\u00a0Yevsin\u2019s case is\u00a0to\u00a0be\u00a0seen in\u00a0the fact that the sentence handed down was\u00a0significantly more severe<\/a>\u00a0than in\u00a0other cases also prosecuted under Article 318 of\u00a0the Russian Criminal Code but unrelated to\u00a0the protests. We\u00a0consider the punishment handed down to\u00a0Yevsin is\u00a0selective and disproportionate to\u00a0the danger to\u00a0the public represented by\u00a0his actions.<\/p>\n
