Memorial Human Rights Centre, in\u00a0accordance with\u00a0international guidelines<\/a>, considers Oleh Prykhodko a\u00a0political prisoner. We\u00a0believe he\u00a0is\u00a0innocent of\u00a0all charges and the case against him has been fabricated. Oleh Prykhodko is\u00a0being prosecuted solely for his political views and in\u00a0violation of\u00a0the right to\u00a0a\u00a0fair trial.<\/p>\n

We\u00a0demand Prykhodko\u2019s immediate release and that his conviction be\u00a0quashed.<\/p>\n

Who is\u00a0Oleh Prykhodko and why has he\u00a0been prosecuted?<\/strong><\/p>\n

Oleh Prykhodko, 63, is\u00a0a\u00a0Ukrainian activist who lives in\u00a0Crimea and takes a\u00a0strongly negative view of\u00a0Russia\u2019s annexation of\u00a0the peninsula.<\/p>\n

At\u00a0the end of\u00a02018\u00a0he was prosecuted for an\u00a0alleged offence under Article\u00a020.3 of\u00a0the Russian Code of\u00a0Administrative Offences, that bans promotion of\u00a0Nazi symbols, because of\u00a0his clothes and tattoos on\u00a0his body.<\/p>\n

In\u00a0October 2019 Prykhodko was arrested by\u00a0FSB officers and charged with the following offences under the Russian Criminal Code: preparation of\u00a0a\u00a0terrorist act (Article\u00a030, Part\u00a01, in\u00a0conjunction with Article 205, Part\u00a01); illegal manufacture and storage of\u00a0explosive devices (Article 223.1, Part\u00a01, Article\u00a030, Part\u00a03, in\u00a0conjunction with Article 223.1, Part\u00a01, and Article 222.1, Part\u00a01).<\/p>\n

In\u00a0March 2021 the Southern District Military Court sentenced Prykhodko to\u00a0five years in\u00a0a\u00a0strict regime penal colony. He\u00a0is\u00a0currently held in\u00a0a\u00a0pre-trial detention centre awaiting consideration of\u00a0his appeal.<\/p>\n

Why does Memorial consider Prykhodko a\u00a0political prisoner?<\/strong><\/p>\n

Having studied the materials of\u00a0the case, we\u00a0conclude that Oleh Prykhodko is\u00a0a\u00a0victim of\u00a0a\u00a0politically motivated prosecution for his pro-Ukrainian political views.<\/p>\n

According to\u00a0the court judgment, Prykhodko made preparations to\u00a0carry out an\u00a0explosion at\u00a0the Saki city government building in\u00a0Crimea and arson of\u00a0the building of\u00a0the Russian consulate in\u00a0Lviv. The prosecution argued that Prykhodko did not manage to\u00a0carry out the crime because of\u00a0circumstances beyond his control. He\u00a0illegally acquired and stored explosives at\u00a0his home, independently made one explosive device and then tried to\u00a0make a\u00a0second.<\/p>\n

Items seized during the search of\u00a0Prykhodko\u2019s garage, as\u00a0well as\u00a0his phone records and text messages, were used by\u00a0the prosecution as\u00a0evidence.<\/p>\n

There are a\u00a0number of\u00a0important inconsistencies in\u00a0the case and it\u00a0is\u00a0highly likely that significant pieces of\u00a0evidence were fabricated during the investigation. For example, no\u00a0attempt was made to\u00a0take fingerprints from the explosive devices and their constituent parts seized in\u00a0Prykhodko\u2019s garage and the investigators did not even attempt to\u00a0explain where the activist could obtain those parts that are not freely available.<\/p>\n

Moreover, we\u00a0believe the law enforcement agencies may themselves have fabricated the text messages which contain details of\u00a0the preparation of\u00a0terrorist attacks.<\/p>\n

Similar occurrences have been identified in\u00a0other cases regarding preparation of\u00a0terrorist attacks in\u00a0Crimea. In\u00a0those cases, Memorial also\u00a0recognised<\/a>\u00a0the defendants as\u00a0political prisoners.<\/p>\n

Finally, the prosecution paid too much attention to\u00a0the political views of\u00a0Oleh Prykhodko, his pro-Ukrainian position and his criticism of\u00a0the annexation of\u00a0Crimea by\u00a0Russia. We\u00a0believe that it\u00a0was his beliefs that served as\u00a0the basis for his criminal prosecution.<\/p>\n
