Memorial<\/span>\u00a0Human Rights Centre, in\u00a0accordance with\u00a0international guidelines<\/a>, considers the criminal prosecution of\u00a0Moscow activists Olga Misik, Igor Basharimov, and Ivan Vorobyovsky politically motivated and unlawful.<\/p>\n

We\u00a0believe the acts imputed to\u00a0the three defendants do\u00a0not provide grounds for their prosecution for vandalism. The criminal proceedings against Misik, Basharimov and Vorobyovsky are politically motivated and intended to\u00a0intimidate Russian civil society and prevent citizens exercising their right to\u00a0freedom of\u00a0expression.<\/p>\n

Who are the defendants and what are they accused\u00a0of?<\/strong><\/p>\n

Olga Misik, 19, Igor Basharimov, 27, and Ivan Vorobyovsky, 24, are opposition activists and supporters of\u00a0the \u2018Perpetual Protest\u2019 in\u00a0Moscow. All three were charged with vandalism committed by\u00a0a\u00a0group of\u00a0people (Article 214, Part\u00a02, of\u00a0the Criminal Code).<\/p>\n

According to\u00a0the investigation, on\u00a0the night of\u00a08\u00a0August 2020, in\u00a0protest against the verdict in\u00a0the\u00a0New Greatness<\/a>\u00a0case the three allegedly put up\u00a0posters on\u00a0the fence outside the Lyublino district court on\u00a0the outskirts of\u00a0Moscow and then, in\u00a0the city centre, splashed red paint on\u00a0the entrance to\u00a0the General Prosecutor\u2019s Office and stuck another poster on\u00a0it.<\/p>\n

According to\u00a0the investigators, Misik, Basharimov, and Vorobyovsky desecrated the buildings of\u00a0the district court and the General Prosecutor\u2019s Office and also damaged the external appearance of\u00a0the Prosecutor General\u2019s building, causing damage costing 3,464 roubles 50\u00a0kopecks.<\/p>\n

The activists were arrested on\u00a09\u00a0August 2020 and released the next day under pre-trial restrictions that banned them from undertaking certain actions.<\/p>\n

In\u00a0February 2021, the case against the activists went to\u00a0court.<\/p>\n

Why\u00a0Memorial<\/span>\u00a0considers the prosecution of\u00a0the three activists politically motivated<\/strong><\/p>\n

We\u00a0believe there are no\u00a0legal grounds either for the criminal prosecution on\u00a0charges of\u00a0vandalism or\u00a0for the pre-trial restrictions imposed on\u00a0the activists.<\/p>\n

The alleged crime of\u00a0vandalism implies desecrating buildings or\u00a0damage to\u00a0property in\u00a0public places with direct intent.<\/p>\n

We\u00a0consider the investigation does not have sufficient grounds to\u00a0claim the buildings of\u00a0the court and of\u00a0the Prosecutor\u2019s Office were desecrated because the actions of\u00a0the activists were aimed not at\u00a0insulting society, but, on\u00a0the contrary, at\u00a0protecting the socially important value of\u00a0justice.<\/p>\n

The material damage allegedly caused by\u00a0Misik, Basharimov, and Vorobyovsky was negligible. Moreover, their legal defence convincingly demonstrated that the evidence of\u00a0damage was falsified.<\/p>\n

In\u00a0any case, for causing the damage with which they have been charged and putting up\u00a0posters in\u00a0unauthorised places, the activists can be\u00a0held liable only under administrative, not criminal, law. We\u00a0believe the criminal prosecution of\u00a0Misik, Basharimov, and Vorobyovsky is\u00a0unfounded and is\u00a0in\u00a0reaction to\u00a0statements they made criticising the politically motivated wrongful convictions in\u00a0the New Greatness trial.<\/p>\n
