Memorial<\/span>\u00a0Human Rights Centre, in\u00a0accordance with\u00a0international guidelines<\/a>, considers Maksim Smolnikov a\u00a0political prisoner. We\u00a0believe he\u00a0is\u00a0being prosecuted for exercising his rights to\u00a0freedom of\u00a0speech, thought and expression. So\u00a0far as\u00a0we\u00a0know, he\u00a0has been imprisoned, in\u00a0the absence of\u00a0any evidence of\u00a0a\u00a0crime, in\u00a0order to\u00a0obstruct his civic activism and to\u00a0stop public discussion about security and terrorism matters. We\u00a0demand Smolnikov\u2019s immediate release from custody.<\/p>\n

Who is\u00a0Maksim Smolnikov and what are the charges against him?<\/strong><\/p>\n

Maksim Smolnikov is\u00a0a\u00a0Khabarovsk artist, civic activist, and employee of\u00a0the regional Centre for Educational Quality Assessment. In\u00a0the anarchist community he\u00a0is\u00a0known by\u00a0the pseudonym Xadad.<\/p>\n

The reason for Smolnikov\u2019s criminal prosecution was a\u00a0post he\u00a0made on\u00a0the Vkontakte social media site about the anarchist Mikhail Zhlobitsky, who blew himself up\u00a0on\u00a031\u00a0October 2018 in\u00a0the headquarters of\u00a0the Arkhangelsk FSB. The day of\u00a0the attack, Smolnikov shared his thoughts on\u00a0the causes and consequences of\u00a0what happened. He\u00a0described the 17-year-old student\u2019s act as\u00a0one of\u00a0desperation, prompted by\u00a0the government\u2019s repressive policies.<\/p>\n

Two and a\u00a0half years later, on\u00a011\u00a0May 2021\u00a0at about 7\u00a0a.m., the authorities conducted a\u00a0search, without a\u00a0warrant, of\u00a0Smolnikov\u2019s apartment. The next day the artist was remanded in\u00a0custody by\u00a0decision of\u00a0the Central district court in\u00a0Khabarovsk.<\/p>\n

Smolnikov has been charged with an\u00a0offence under Article 205.2, Part\u00a02, of\u00a0the Russian Criminal Code\u00a0\u2014 public justification of\u00a0terrorism\u00a0\u2014 that carries a\u00a0maximum penalty of\u00a0seven years\u2019 imprisonment. According to\u00a0the Investigative Committee, Smolnikov\u2019s post could be\u00a0seen as\u00a0justifying terrorism.<\/p>\n

Smolnikov himself did not plead guilty and refused to\u00a0testify, relying on\u00a0Article 51\u00a0of\u00a0the Russian Constitution.<\/p>\n

Why\u00a0Memorial<\/span>\u00a0considers Smolnikov a\u00a0political prisoner?<\/strong><\/p>\n

Maksim Smolnikov\u2019s arrest coincided with a\u00a0fresh wave of\u00a0repression against opposition activists in\u00a0Khabarovsk. Over the past three months, Aleksei Vorsin, former coordinator of\u00a0Navalny\u2019s headquarters, was placed under house arrest, activist Denis Posmetiukhin was sentenced to\u00a0one year in\u00a0a\u00a0penal colony and a\u00a0criminal investigation concerning violence against a\u00a0police officer was initiated against Elmira Kyalunziga, a\u00a0supporter of\u00a0former Khabarovsk region governor Sergei Furgal.<\/p>\n

We\u00a0believe Maksim Smolnikov was deprived of\u00a0liberty without having committed a\u00a0crime and in\u00a0the absence of\u00a0any evidence of\u00a0one being committed.<\/p>\n

The explanatory note to\u00a0Article 205.2 of\u00a0the Russian Criminal Code defines the public justification of\u00a0terrorism as \u2018a public statement acknowledging the ideology and practice of\u00a0terrorism as\u00a0correct and something to\u00a0be\u00a0supported and imitated.\u2019 There is\u00a0no\u00a0other legal definition of\u00a0this concept in\u00a0Russian law.<\/p>\n

Smolnikov\u2019s online publication does not state that the ideology or\u00a0practice of\u00a0terrorism is\u00a0correct or\u00a0should be\u00a0imitated; neither does it\u00a0express approval of\u00a0Zhlobitsky\u2019s act, nor call for his example to\u00a0be\u00a0followed. Moreover, the post clearly expresses regret that the young anarchist could not find a\u00a0more constructive form of\u00a0struggle against state repression. And in\u00a0listing possible negative consequences of\u00a0Zhlobitsky\u2019s act\u00a0\u2014 including increased pressure on\u00a0left-wing activists and a\u00a0worsening in\u00a0the situation of\u00a0those imprisoned in\u00a0the Network case\u00a0\u2014 Smolnikov concludes that what Zhlobitsky did will only exacerbate the injustice that gave rise to\u00a0his anger.<\/p>\n

Maksim Smolnikov\u2019s prosecution violates his right to\u00a0freedom of\u00a0expression guaranteed by\u00a0Article 29\u00a0of\u00a0the Russian Constitution and Article 10\u00a0of\u00a0the European Convention for the Protection of\u00a0Human Rights and Fundamental Freedoms. In\u00a0recent years, Article 205.2 of\u00a0the Russian Criminal Code has become the main tool of\u00a0the criminal law used as\u00a0a\u00a0means of\u00a0repression with regard to\u00a0statements made online. We\u00a0now know of\u00a0more than 20\u00a0criminal cases initiated for statements about what Zhlobitsky did.<\/p>\n

We\u00a0believe that an\u00a0analysis of\u00a0the reasons for a\u00a0terrorist attack cannot and should not be\u00a0considered an\u00a0endorsement or\u00a0justification of\u00a0such an\u00a0act. It\u00a0seems obvious that any terrorist act has social or\u00a0political causes that society needs to\u00a0analyse and understand. Prohibiting public discussion of\u00a0the factors that motivate terrorism is\u00a0unlawful and harmful to\u00a0society.<\/p>\n

We\u00a0oppose a\u00a0broad interpretation of\u00a0the term \u2018justification of\u00a0terrorism\u2019 and unwarranted criminalization of\u00a0public discussion about terrorism.<\/p>\n

Recognition of\u00a0an\u00a0individual as\u00a0a\u00a0political prisoner does not imply\u00a0Memorial<\/span>\u00a0Human Rights Centre agrees with, or\u00a0approves\u00a0of, their views, statements, or\u00a0actions.<\/em><\/p>\n
