Memorial<\/span>\u00a0Human Rights Centre, in\u00a0accordance with\u00a0international guidelines<\/a>\u00a0defining the term \u2018political prisoner\u2019, considers the criminal prosecution of\u00a0Aleksandr Federyakov politically motivated and unlawful. Federyakov is\u00a0remanded in\u00a0custody for his political beliefs and for exercising his right to\u00a0freedom of\u00a0assembly. The evidence for the charges against him is\u00a0extremely weak. The fact that the court chose the most severe form of\u00a0pretrial restriction and the sentence he\u00a0has been given are clearly disproportionate to\u00a0the offence with which he\u00a0has been charged. Moreover, his prosecution has a\u00a0selective nature, given the usual, \u2018non-political\u2019 practice with regard to\u00a0the offence of\u00a0use of\u00a0force against a\u00a0public official (Article 318 of\u00a0the Russian Criminal Code).<\/span><\/p>\n

We\u00a0believe Aleksandr Federyakov should be\u00a0immediately released and the criminal charges against him dropped.<\/p>\n

What are the charges against Aleksandr Federyakov?<\/strong><\/p>\n

On\u00a023 January 2021 Aleksandr Federyakov took part in\u00a0a\u00a0protest in\u00a0Moscow in\u00a0support of\u00a0Aleksei Navalny.<\/p>\n

According to\u00a0Federyakov, that day he\u00a0walked along the boulevard from Pushkinskaya metro station to\u00a0Trubnaya metro station. On\u00a0the way, he\u00a0saw several people being arrested but did not take part in\u00a0the events himself. When he\u00a0reached Trubnaya station he\u00a0went down into the metro and went home.<\/p>\n

According to\u00a0the prosecution, at\u00a0Trubnaya station Federyakov fired pepper spray in\u00a0the face of\u00a0a\u00a0riot police officer. Criminal charges were brought against Federyakov for \u2018use of\u00a0violence, not dangerous to\u00a0life or\u00a0health, against a\u00a0public official in\u00a0connection with the performance of\u00a0their duties\u2019 (Article 318, Part\u00a01, of\u00a0the Russian Criminal Code).<\/p>\n

On\u00a031 March 2021 Federyakov was arrested and remanded in\u00a0custody. On\u00a09 August 2021\u00a0he was found guilty and sentenced to\u00a0one year and six months in\u00a0a\u00a0general regime penal colony.<\/p>\n

Federyakov maintains\u00a0his innocence<\/a>. He\u00a0has said: \u2018I consider myself innocent. The investigation did not provide any evidence of\u00a0my\u00a0guilt. My\u00a0position is\u00a0unambiguous: I\u00a0am not guilty and it\u00a0is\u00a0important for me\u00a0to\u00a0show I\u00a0am right. Maybe this will be\u00a0an\u00a0example of\u00a0how a\u00a0person is\u00a0able to\u00a0establish the truth in\u00a0our justice system?\u2019<\/p>\n

Why does\u00a0Memorial<\/span>\u00a0consider Aleksandr Federyakov a\u00a0political prisoner?<\/strong><\/p>\n

As\u00a0evidence of\u00a0Federyakov\u2019s guilt, investigators presented a\u00a0video recording of\u00a0the alleged moment when pepper spray was fired in\u00a0the direction of\u00a0the riot police officer. The video, shot in\u00a0poor light conditions, shows the back of\u00a0a\u00a0person wearing a\u00a0dark hoodie. It\u00a0is\u00a0impossible to\u00a0identify a\u00a0person on\u00a0the basis of\u00a0this image: neither the face nor any particular features of\u00a0the alleged offender are visible on\u00a0the video.<\/p>\n

The investigators have provided no\u00a0other evidence of\u00a0Federyakov\u2019s guilt. No\u00a0one was able to\u00a0identify him, and there were no\u00a0traces of\u00a0pepper spray on\u00a0clothes seized from his home.<\/p>\n

Nevertheless, the court chose the most severe form of\u00a0pretrial restriction for Federyakov and then sentenced Federyakov to\u00a0one year and a\u00a0half of\u00a0imprisonment in\u00a0a\u00a0general regime penal colony.<\/p>\n

Federyakov had no\u00a0previous convictions. He\u00a0is\u00a0married with one young child.<\/p>\n

The general practice for cases falling under the article of\u00a0the Criminal Code concerning violence against a\u00a0public official in \u2018non-political\u2019 cases is\u00a0much milder and imprisonment is\u00a0not usual.<\/p>\n

All this indicates the obvious bias and selectivity in\u00a0the criminal prosecution of\u00a0Aleksandr Federyakov. Society is\u00a0being given a\u00a0clear signal: police officers are allowed to\u00a0do\u00a0whatever they like; ordinary people who dare to\u00a0take part in\u00a0protests will be\u00a0punished with maximum severity.<\/p>\n

Recognition of\u00a0an\u00a0individual as\u00a0a\u00a0political prisoner does not imply\u00a0Memorial<\/span>\u00a0Human Rights Centre agrees with, or\u00a0approves\u00a0of, their views, statements, or\u00a0actions.<\/em><\/p>\n
