Memorial Human Rights Centre, in\u00a0accordance with\u00a0guidelines<\/a>\u00a0defining the term \u2018political prisoner,\u2019 considers Radik Khairutdinov and Elmar Mamedov political prisoners. We\u00a0believe they are being prosecuted for political reasons because of\u00a0their non-violent exercise of\u00a0the rights to\u00a0freedom of\u00a0conscience, religion, speech and association in\u00a0order to\u00a0strengthen and maintain the authority of\u00a0those in\u00a0power. On\u00a0the basis of\u00a0current information, they are being deprived of\u00a0liberty in\u00a0the absence of\u00a0a\u00a0crime and in\u00a0violation of\u00a0their right to\u00a0a\u00a0fair trial. Memorial calls for the immediate release of\u00a0Khairutdinov and Mamedov.<\/strong><\/p>\n

Who are Radik Khairutdinov and Elmar Mamedov?<\/strong><\/p>\n

Radik Khairutdinov, 34, and Elmar Mamedov, 32, were detained on\u00a023 September 2019 in\u00a0Tolyatti together with two other local Muslims\u00a0\u2014\u00a0Rais Mavlyutov<\/a>\u00a0and Aleksei Botva. They were then all taken into custody.<\/p>\n

Khairutdinov and Mamedov have been charged with participation in\u00a0the activities of\u00a0a\u00a0terrorist organisation (Article 205.5, Part 2, of\u00a0the Russian Criminal Code) because of\u00a0their involvement in\u00a0the Islamic party Hizb ut-Tahrir al-Islami, which is\u00a0banned in\u00a0Russia.<\/p>\n

In\u00a0addition, Mamedov has been charged with justification of\u00a0terrorism (Article 205.2, Part 2, of\u00a0the Russian Criminal Code) for posting on\u00a0his Facebook page two videos and photos of\u00a0military operations in\u00a0Syria.<\/p>\n

Their trial has now begun in\u00a0the Volga District Military Court in\u00a0Samara.<\/p>\n

Why does Memorial consider them political prisoners?<\/strong><\/p>\n

The charges of\u00a0terrorism against Khairutdinov and Mamedov are based solely on\u00a0their membership of\u00a0the Islamic party Hizb ut-Tahrir al-Islami, which is\u00a0banned in\u00a0Russia. We\u00a0believe the designation of\u00a0this organisation as\u00a0terrorist is\u00a0unjustified and unlawful. The decision of\u00a0the Russian Supreme Court, adopted in\u00a02003, which banned the activities of\u00a0a\u00a0large number of\u00a0Islamic organisations, devoted one paragraph of\u00a0three sentences to\u00a0Hizb ut-Tahrir. The three sentences contain no\u00a0evidence of\u00a0terrorist activities.<\/p>\n

Since November 2013, when Article 205.5 was added to\u00a0the Russian Criminal Code, the mere fact of\u00a0participation in\u00a0events held by\u00a0Hizb ut-Tahrir has been sufficient to\u00a0be\u00a0convicted of\u00a0a\u00a0terrorist offence, the penalties for which even include life imprisonment. At\u00a0the same time, for a\u00a0conviction to\u00a0be\u00a0brought, it\u00a0has ceased to\u00a0be\u00a0necessary to\u00a0prove facts of\u00a0preparation or\u00a0implementation of\u00a0terrorist crimes.<\/p>\n

We\u00a0would point out that Article 28 of\u00a0the Russian Constitution guarantees everyone \u2018freedom of\u00a0conscience, freedom of\u00a0religion, including the right to\u00a0profess individually, or\u00a0jointly with others, any religion or\u00a0not to\u00a0profess any religion, to\u00a0freely choose, have and disseminate religious and other beliefs and act in\u00a0accordance with them.\u2019<\/p>\n

There is\u00a0no\u00a0evidence that the defendants committed or\u00a0planned violence, still less committed actions that can be\u00a0called terrorism in\u00a0the common sense meaning of\u00a0the term.<\/p>\n

The prosecution is\u00a0based on\u00a0the testimonies of\u00a0three classified witnesses who stated that the defendants proposed, in\u00a0the mosque, that they become acquainted with the literature of\u00a0Hizb ut-Tahrir; and on\u00a0the testimonies of\u00a0one person now in\u00a0prison, also convicted of\u00a0membership in\u00a0Hizb ut-Tahrir, and of\u00a0the accomplice of\u00a0the defendants who pleaded guilty and reached a\u00a0plea bargain with the investigators.<\/p>\n

According to\u00a0the indictment, the whole guilt of\u00a0the defendants lies in\u00a0the fact that they \u2018deliberately and purposefully, jointly and by\u00a0mutual agreement, acquired a\u00a0thorough knowledge of\u00a0the ideology of\u00a0the organisation\u2019 and \u2018misled Muslims, in\u00a0terms of\u00a0their religion, substituting for the traditional approach to\u00a0disseminating this religion in\u00a0society the notion of\u00a0fostering organised anti-constitutional activities in\u00a0the Russian Federation, based on\u00a0the doctrine of\u00a0the fundamental stage-by-stage creation of\u00a0a\u00a0theocratic unitary state\u00a0\u2014 the World Islamic Caliphate\u00a0\u2014 that contradicts the traditional interpretation of\u00a0Islam.\u2019<\/p>\n

In\u00a0other words, they are officially accused of\u00a0distorting the ideas of\u00a0Islam. However, a\u00a0decision on\u00a0the \u2018correctness\u2019 of\u00a0believers\u2019 interpretations of\u00a0religious and philosophical issues in\u00a0no\u00a0way lies within the competence of\u00a0the State or\u00a0of\u00a0the investigative bodies and does not correspond to\u00a0those articles of\u00a0the Criminal Code under which the charges have been brought.<\/p>\n

As\u00a0far as\u00a0the charges of\u00a0advocating terrorism laid against Mamedov are concerned, the video clips he\u00a0published are only about the humanitarian catastrophe in\u00a0the Syrian city of\u00a0Aleppo during its siege by\u00a0government troops. They do\u00a0not contain any incitement of\u00a0violence or\u00a0justification of\u00a0terrorism, but condemn the use of\u00a0weapons of\u00a0mass destruction in\u00a0a\u00a0military conflict that primarily affects the civilian population. The fact that Mamedov is\u00a0accused of\u00a0reposting materials from official and well-known media, the BBC and Radio Liberty, which are officially registered and operate legally in\u00a0Russia, is\u00a0particularly surprising and cause for concern. These materials were posted on\u00a0the websites of\u00a0these media outlets and no\u00a0complaints were made about them by\u00a0Russian investigative or\u00a0supervisory bodies. The only reference to\u00a0ISIS, which is\u00a0banned in\u00a0Russia and whose propaganda Mamedov is\u00a0accused of\u00a0disseminating, is\u00a0the phrase \u2018ISIS could never have dreamt of\u00a0such a\u00a0thing\u2019 in\u00a0his comments on\u00a0the publications.<\/p>\n

Recognition of\u00a0an\u00a0individual as\u00a0a\u00a0political prisoner or\u00a0as\u00a0a\u00a0victim of\u00a0politically motivated prosecution does not imply Memorial Human Rights Centre agrees with, or\u00a0approves of, their views, statements, or\u00a0actions.<\/em><\/p>\n
