Memorial Human Rights Centre considers Magomed Khamkhoyev, a\u00a0defendant in\u00a0the \u2018Ingush case\u2019 (a\u00a0prosecution of\u00a0a\u00a0number of\u00a0opposition activists), a\u00a0political prisoner. We\u00a0believe the criminal prosecution of\u00a0Khamkhoyev is\u00a0based solely on\u00a0his participation in\u00a0a\u00a0peaceful protest against the actions of\u00a0the Ingush authorities and demand his immediate release.<\/p>\n

Context: how the Ingush authorities suppressed the March 2019 protest<\/strong><\/p>\n

In\u00a0the autumn of\u00a02018 Ramzan Kadyrov and Yunus-Bek Yevkurov signed an\u00a0agreement, \u2018On\u00a0the Establishment of\u00a0the Border\u2026,\u2019 under which part of\u00a0the territory of\u00a0Ingushetia was transferred to\u00a0Chechnya. The document was prepared in\u00a0secret. A\u00a0very large part of\u00a0the population of\u00a0Ingushetia rose up\u00a0to\u00a0protest.<\/p>\n

On\u00a026 March 2019 a\u00a020,000-strong rally was held in\u00a0Magas, the capital of\u00a0Ingushetia, demanding the resignation of\u00a0the Ingush leadership and the holding of\u00a0free elections. The authorities agreed to\u00a0allow the rally to\u00a0last for one day, but some of\u00a0the participants declared the protest \u2018indefinite.\u2019 On\u00a0the morning of\u00a027 March several hundred people remained on\u00a0the square. These protesters did not pose a\u00a0threat to\u00a0public order and did not interfere with traffic, pedestrians or\u00a0the functioning of\u00a0institutions.<\/p>\n

Nevertheless, officers of\u00a0the National Guard sent to\u00a0Ingushetia from other Russian regions attempted to\u00a0disperse the protesters. Investigators working on\u00a0the case claim that ten law enforcement officers were injured in\u00a0clashes that followed.<\/p>\n

After the clashes in\u00a0Magas, criminal proceedings were initiated and dozens of\u00a0protesters were arrested. More than two dozen demonstrators have already been convicted on\u00a0charges of\u00a0using minor forms of\u00a0violence against law enforcement officials and eight protest leaders have been charged, without evidence, of\u00a0organising this violence. Memorial Human Rights Centre\u00a0has declared<\/a>\u00a0those convicted or\u00a0remanded in\u00a0custody in\u00a0the case to\u00a0be\u00a0political prisoners.<\/p>\n

The charges: from violence to\u00a0incitement of\u00a0violence<\/strong><\/p>\n

Magomed Khamkhoyev was arrested in\u00a0early April 2019 and charged, along with more than three dozen other participants in\u00a0the Magas rally, of\u00a0using violence dangerous to\u00a0the life or\u00a0health of\u00a0public officials under Part 2 of\u00a0Article 318 of\u00a0the Criminal Code.<\/p>\n

However, the investigating officers concluded that Khamkhoyev did not commit this crime. Despite this, he\u00a0was not released. Instead, at\u00a0the beginning of\u00a02020 new charges were brought against Khamkhoyev for an\u00a0offence under Part 4 of\u00a0Article 33 in\u00a0conjunction with Part 1 of\u00a0Article 318 of\u00a0the Russian Criminal Code (\u2018Incitement to\u00a0violence non-threatening to\u00a0life or\u00a0health against public officials,\u2019 punishable by\u00a0up\u00a0to\u00a0five years in\u00a0prison).<\/p>\n

The Investigative Committee claims Magomed Khamkhoyev \u2018persuaded\u2019 the rally participants to\u00a0use violence that was not dangerous to\u00a0life or\u00a0health against law enforcement officers. Giving in\u00a0to\u00a0this persuasion, the demonstrators \u2018struck on\u00a0various parts of\u00a0the body\u2019 65 National Guard officers and one Ingushetian police officer \u2018with their hands and feet, stones, chairs, sticks, metal turnstiles or\u00a0pieces of\u00a0them, as\u00a0well as\u00a0other improvised objects.\u2019 As\u00a0a\u00a0result, 58 of\u00a0these officers experienced physical pain, while eight suffered bodily injuries that did not harm their health such as\u00a0abrasions, contusions and bruises.<\/p>\n

The trial has begun.<\/p>\n

Why Memorial considers Khamkhoyev a\u00a0political prisoner<\/strong><\/p>\n

According to\u00a0international standards of\u00a0freedom of\u00a0peaceful assembly as\u00a0set out in\u00a0documents of\u00a0the UN\u00a0and the European Court of\u00a0Human Rights, a\u00a0state must not forcibly disperse demonstrations if\u00a0the actions of\u00a0its participants do\u00a0not pose a\u00a0danger to\u00a0the public, even if\u00a0the event has not been authorised. Therefore, we\u00a0consider the attempt to\u00a0forcibly disperse the rally in\u00a0Ingushetia on\u00a027 March 2019 unlawful.<\/p>\n

After reading Magomed Khamkhoyev\u2019s\u00a0indictment, we\u00a0discovered that only one witness, \u2018I. Iliev\u2019, whose true identity was kept secret, allegedly heard Khamkhoyev\u2019s\u00a0calls to\u00a0violence at\u00a0the rally. \u2018I. Iliev\u2019 testified that he\u00a0had heard Magomed Khamkhoyev calling on\u00a0activists to\u00a0\u2018stand to\u00a0the end, even if\u00a0we\u00a0have to\u00a0fight.\u2019<\/p>\n

Moreover, the investigators only \u2018discovered\u2019 this witness in\u00a0December 2019, nine months after the investigation began, and his testimony was contradictory. In\u00a0his first interrogation on\u00a016 December 2019, Iliev claimed that he\u00a0saw Khamkhoyev \u2018walking among young people and talking.\u2019 Iliev \u2018approached a\u00a0group of\u00a0young guys\u2019 and asked them \u2018what M. M. Khamkhoyev wanted, to\u00a0which they replied that M. M. Khamkhoyev had asked everyone to\u00a0stand to\u00a0the end\u2026.\u2019 Two days later, during an\u00a0interrogation on\u00a018 December, Iliev changed his testimony. He\u00a0said that he\u00a0could not describe the people who had conveyed Khamkhoyev\u2019s\u00a0words to\u00a0him because he\u00a0was afraid of\u00a0them. The indictment cites his testimony in\u00a0this way: \u2018In\u00a0fact, he\u00a0heard all these words from M. M. Khamkhoyev himself.\u2019 The investigation has no\u00a0other evidence of\u00a0Magomed Khamkhoyev\u2019s\u00a0guilt. We\u00a0suspect that the testimony of\u00a0the witness \u2018Iliev\u2019 is\u00a0fabricated, as\u00a0it\u00a0appears improbable. However, even from this it\u00a0is\u00a0impossible to\u00a0conclude unequivocally that Khamkhoyev incited violence.<\/p>\n

It\u00a0is\u00a0outrageous that such an\u00a0absolutely groundless and unsubstantiated indictment was approved by\u00a0the deputy Prosecutor General and submitted to\u00a0court.<\/p>\n

Thirty-four-year-old Magomed Khamkhoyev was not one of\u00a0the organisers or\u00a0ideological leaders of\u00a0the rally in\u00a0question. As\u00a0far as\u00a0we\u00a0know, he\u00a0is\u00a0not a\u00a0civil society activist. As\u00a0the investigation showed, he\u00a0did not participate in\u00a0clashes with law enforcement officials on\u00a027 March 2019. We\u00a0therefore believe there was only one reason why Khamkhoyev was arrested and prosecuted, namely to\u00a0put pressure on\u00a0his close relatives. He\u00a0is\u00a0the son-in-law of\u00a0one of\u00a0the main persons accused, the Ingush elder Akhmed Barakhoyev, and a\u00a0nephew of\u00a0Isa Khamkhoyev, the Mufti of\u00a0Ingushetia. The then head of\u00a0the region, Yunus-Bek Yevkurov, had been in\u00a0conflict with the Mufti for several years. On\u00a0the day of\u00a0the rally, 26 March 2019, Yevkurov went on\u00a0Ingush television to\u00a0name the Ingush Muftiate as\u00a0the main instigator of\u00a0unrest in\u00a0the republic. From the beginning of\u00a0April 2019, the homes of\u00a0the Mufti and his relatives, along with offices of\u00a0the Muftiate, were subjected to\u00a0numerous searches.<\/p>\n

Memorial believes that the aim of\u00a0those behind the \u2018Ingush case\u2019 is\u00a0to\u00a0silence the protest movement in\u00a0the republic and teach a\u00a0\u2018lesson\u2019 to\u00a0other Russian regions. The prosecution of\u00a0Ingush opposition activists is\u00a0another step towards suppressing legitimate civic activity and the rights and freedoms, not only of\u00a0residents of\u00a0Ingushetia, but also of\u00a0Russian citizens in\u00a0general.<\/p>\n

Memorial Human Rights Centre, according to\u00a0international guidelines<\/a>\u00a0defining the term \u2018political prisoner,\u2019 believes the criminal prosecution of\u00a0Magomed Khamkhoyev is\u00a0intended to\u00a0forcibly end public criticism of\u00a0the authorities by\u00a0residents of\u00a0Ingushetia and he\u00a0has been imprisoned solely for the non-violent exercise of\u00a0the right to\u00a0peaceful assembly.<\/p>\n
