Memorial Human Rights Centre, in\u00a0line with\u00a0international guidelines<\/a>\u00a0defining the term \u2018political prisoner,\u2019 considers 29-year-old Kursk resident Sergei Lavrov a\u00a0political prisoner. Lavrov\u2019s\u00a0prosecution has had the aim of\u00a0forcing him to\u00a0cease his civic activism and public criticism of\u00a0the authorities. He\u00a0was deprived of\u00a0his liberty in\u00a0violation of\u00a0the right to\u00a0a\u00a0fair trial, freedom of\u00a0thought and expression and other rights and freedoms guaranteed by\u00a0the International Covenant on\u00a0Civil and Political Rights and the European Convention for the Protection of\u00a0Human Rights and Fundamental Freedoms. There is\u00a0no\u00a0evidence he\u00a0committed a\u00a0crime. We\u00a0believe the criminal charges against Lavrov should be\u00a0dropped and he\u00a0himself released immediately.<\/strong><\/p>\n

Who is\u00a0Sergei Lavrov and what is\u00a0he\u00a0accused of?<\/strong><\/p>\n

The prosecution of\u00a0the 29-year-old left-wing activist from Kursk, Sergei Lavrov, for criticizing the Russian authorities on\u00a0the Internet began in\u00a02015. At\u00a0first, he\u00a0was charged with insulting the president (the charges were dropped), then with inciting extremist activities (for which he\u00a0was convicted and immediately amnestied).<\/p>\n

In\u00a02019, Lavrov was prosecuted on\u00a0seven charges of\u00a0inciting terrorism and justifying terrorist activity (Article 205.5, Part 2, of\u00a0the Criminal Code) for publishing on\u00a0his VKontakte page, and the groups he\u00a0moderated on\u00a0the site, seven posts about the need for \u2018a\u00a0people\u2019s\u00a0revolution in\u00a0order to\u00a0create a\u00a0people\u2019s\u00a0state in\u00a0the interests of\u00a0all Russians.\u2019 Twelve assessments by\u00a0experts at\u00a0the Kursk Laboratory for Forensic Examination of\u00a0the Russian Ministry of\u00a0Justice, conducted at\u00a0the request of\u00a0the investigators, concluded that all the posts contained incitement to\u00a0acts of\u00a0violence.<\/p>\n

All the texts imputed to\u00a0Lavrov say that a\u00a0\u2018people\u2019s\u00a0revolution\u2019 and the establishment of\u00a0people\u2019s\u00a0power in\u00a0Russia are inevitable and necessary as\u00a0a\u00a0response to\u00a0the policy pursued by\u00a0the Russian authorities. The experts concluded that such texts, based on\u00a0a\u00a0broad interpretation of\u00a0the notion \u2018justification of\u00a0terrorism,\u2019 were oriented towards terrorism. In\u00a0their opinion, the purpose of\u00a0revolution is\u00a0to\u00a0change those in\u00a0power, which in\u00a0turn implies \u2018destabilization of\u00a0the activities of\u00a0official bodies,\u2019 which is\u00a0one of\u00a0the elements of\u00a0the definition of\u00a0terrorism.<\/p>\n

Why do\u00a0we\u00a0consider Lavrov a\u00a0political prisoner?<\/strong><\/p>\n

In\u00a0the texts in\u00a0question, Lavrov does not explain what he\u00a0means by\u00a0a\u00a0\u2018people\u2019s\u00a0revolution.\u2019 However, having read his personal page on\u00a0VKontakte (which was read by\u00a050 to\u00a0300 regular subscribers rather than by\u00a0an\u00a0\u2018unlimited, wide audience,\u2019 as\u00a0the court argued), we\u00a0can definitively state that Lavrov spoke only of\u00a0peaceful forms of\u00a0protest \u2018within the framework of\u00a0Article 31 of\u00a0the Constitution,\u2019 that people should go\u00a0to\u00a0the streets peacefully and without weapons, as\u00a0well as\u00a0taking part in\u00a0elections and running awareness-raising campaigns. In\u00a0court he\u00a0explained his political position in\u00a0the same way.<\/p>\n

In\u00a0various countries, changing those who are in\u00a0power is\u00a0often the result of\u00a0peaceful non-violent civic protests. Neither legally nor morally can such \u2019revolutions\u2019 be\u00a0equated with terrorism.<\/p>\n

Any definition of\u00a0terrorism must refer to\u00a0acts of\u00a0violence. Our analysis shows that none of\u00a0the publications for which Lavrov has been charged constitutes a\u00a0public statement advocating the ideology and practice of\u00a0terrorism as\u00a0something that is\u00a0right and in\u00a0need of\u00a0support or\u00a0emulation. In\u00a0other words, they do\u00a0not constitute justification of\u00a0terrorism as\u00a0defined in\u00a0the criminal law. A\u00a0charge brought under a\u00a0\u2018terrorist\u2019 article of\u00a0the Criminal Code appears plainly excessive and is\u00a0disproportionate to\u00a0the danger to\u00a0society represented by\u00a0the action in\u00a0question. At\u00a0the same time, the reasoning employed by\u00a0the experts and the court clearly shows elements of\u00a0manipulation aimed at\u00a0bringing in\u00a0a\u00a0guilty verdict in\u00a0the case.<\/p>\n

The medical aspect of\u00a0the sentence deserves particular attention. The forensic psychiatric examination found Lavrov sane, noting that he\u00a0had a\u00a0condition that allowed for a\u00a0very wide range of\u00a0manifestations. In\u00a0our opinion, in\u00a0recognizing Lavrov as\u00a0responsible for his actions, and at\u00a0the same time sending him for compulsory treatment, the court made an\u00a0evidently contradictory decision. Moreover, it\u00a0is\u00a0difficult to\u00a0imagine how, once in\u00a0a\u00a0penal colony, Lavrov would be\u00a0able to\u00a0receive qualified specialist assistance. The inability to\u00a0ensure Sergei Lavrov\u2019s\u00a0right to\u00a0receive qualified medical care forces us\u00a0to\u00a0express serious fears for his life and health.<\/p>\n

Recognition of\u00a0an\u00a0individual as\u00a0a\u00a0political prisoner or\u00a0as\u00a0a\u00a0victim of\u00a0politically motivated prosecution does not imply Memorial Human Rights Centre agrees with, or\u00a0approves of, their views, statements, or\u00a0actions.<\/em><\/p>\n
