Memorial Human Rights Centre, in\u00a0accordance with\u00a0international criteria<\/a>, considers Rakhmiddin Kamolov a\u00a0political prisoner. We\u00a0believe Kamolov has been prosecuted for political reasons for the non-violent exercise of\u00a0his rights to\u00a0freedom of\u00a0conscience, religion, speech and association. In\u00a0so\u00a0doing, his right to\u00a0fair trial has been violated. The aim of\u00a0the prosecution has been to\u00a0force Kamolov to\u00a0cease his civil society activities. Memorial calls for the immediate release of\u00a0the human rights defender.<\/strong><\/p>\n

Who is\u00a0Rakhmiddin Kamolov?<\/strong><\/p>\n

Rakhmiddin Kamolov is\u00a0an\u00a0Uzbekistani citizen who has lived, since 2010, in\u00a0Moscow, where he\u00a0engaged in\u00a0human rights activities with the organizations Yordam (\u2018Help\u2019 in\u00a0Uzbek), that provides assistance to\u00a0refugees from Central Asia, and the Society of\u00a0Political Emigrants of\u00a0Central Asia, where he\u00a0was an\u00a0assistant to\u00a0the Society\u2019s\u00a0president, the well-known Uzbekistani dissident and human rights activist Bakhrom Khamroyev.<\/p>\n

In\u00a02015, criminal charges were laid against Kamolov in\u00a0Uzbekistan for alleged membership in\u00a0a\u00a0Moscow group of\u00a0the \u2018religious extremist\u2019 party Hizb ut-Tahrir, the main goal of\u00a0which, according to\u00a0Uzbek security officials, is\u00a0the illegal overthrow of\u00a0the country\u2019s\u00a0government. The accused was placed on\u00a0an\u00a0international wanted list. Rakhmiddin Kamolov applied for asylum in\u00a0Russia, but was refused and in\u00a0August 2016 he\u00a0was taken into custody, in\u00a0preparation for his extradition, which did not take place thanks to\u00a0the intervention of\u00a0human rights defenders.<\/p>\n

What was Kamolov accused of\u00a0in\u00a0Russia?<\/strong><\/p>\n

In\u00a0March 2017 the FSB brought a\u00a0criminal case against Kamolov under Part 1 of\u00a0Article 205.5 of\u00a0the Russian Criminal Code on\u00a0charges of\u00a0organizing the activities of\u00a0Hizb ut-Tahrir, an\u00a0international Islamic party designated in\u00a02003 as\u00a0terrorist by\u00a0decision of\u00a0the Russian Supreme Court. According to\u00a0the investigation, Rakhmiddin Kamolov participated in\u00a0two meetings with members of\u00a0Hizb ut-Tahrir, and organized another meeting with two Muslims.<\/p>\n

In\u00a0December 2017, the Moscow District Military Court sentenced Kamolov to\u00a016 years\u2019 deprivation of\u00a0liberty in\u00a0a\u00a0strict-regime colony.<\/p>\n

Why Memorial considers Kamolov a\u00a0political prisoner<\/strong><\/p>\n

Kamolov was found guilty only of\u00a0being (according to\u00a0the prosecution, he\u00a0himself denies this) a\u00a0member of\u00a0a\u00a0civil society association. He\u00a0was not charged with violence, preparing terrorist attacks or\u00a0voicing terrorist threats.<\/p>\n

Memorial considers the designation of Hizb ut-Tahrir a terrorist organization unlawful. The decision of the Supreme Court, adopted in closed session without the participation of the association\u2019s representatives, devotes one paragraph of three sentences to Hizb ut-Tahrir. They contain no evidence of terrorist activities.<\/p>\n

It\u00a0is\u00a0precisely the designated status of\u00a0\u2018terrorist organisation\u2019 that allows any of\u00a0its activities\u00a0\u2014 meetings, tea-drinking sessions, discussions, etc. \u2014\u00a0to\u00a0be\u00a0considered \u2018terrorist.\u2019<\/p>\n

We\u00a0point out that Article 28 of\u00a0the Russian Constitution protects these activities by\u00a0believers. Article 28 guarantees everyone \u2018freedom of\u00a0conscience, freedom of\u00a0religion, including the right, either individually or\u00a0in\u00a0community with others, to\u00a0profess or\u00a0not to\u00a0profess any religion, to\u00a0freely choose, hold, disseminate and act in\u00a0conformity with religious and other beliefs.\u2019<\/p>\n

An\u00a0even more blatant violation of\u00a0law and morality is\u00a0the fact that Kamolov\u2019s\u00a0human rights activities were the reason for his prosecution.<\/p>\n

The Russian authorities, instead of\u00a0granting asylum to\u00a0a\u00a0victim of\u00a0political persecution in\u00a0a\u00a0neighbouring authoritarian state, not only denied him this, but also initiated criminal proceedings against him themselves. The convenient and familiar charge of\u00a0involvement in\u00a0Hizb ut-Tahrir has become an\u00a0instrument of\u00a0solidarity among the security agencies of\u00a0the authoritarian regimes of\u00a0Russia and Uzbekistan in\u00a0the fight against their political opponents.<\/p>\n

Recognition of\u00a0an\u00a0individual as\u00a0a\u00a0political prisoner does not imply that Memorial Human Rights Centre agrees with their views or\u00a0statements, nor approves their statements or\u00a0actions.<\/em><\/p>\n
