Memorial Human Rights Centre believes Altynbek Abdymanap uulu and Khotamzhon Karimov\u00a0\u2014 two Muslims, from Moscow and Penza regions respectively\u00a0\u2014 are being prosecuted for political reasons on\u00a0account of\u00a0their non-violent exercise of\u00a0the rights to\u00a0freedom of\u00a0conscience, religion and association. In\u00a0accordance with\u00a0international criteria<\/a>, Khotamzhon Karimov and Altynbek Abdymanap uulu are political prisoners. Memorial demands their immediate release.<\/strong><\/p>\n

What is\u00a0known about the prosecutions of\u00a0the two Muslims?<\/strong><\/p>\n

Altynbek Abdymanap uulu learned about the meetings held for the purpose of\u00a0studying Islam in\u00a0the winter 2014. On\u00a025 January 2015 he\u00a0attended a\u00a0meeting for the first time and learned they were run by\u00a0Hizb ut-Tahrir. Participants took turns reading out extracts from religious books and the leader of\u00a0the meeting commented on\u00a0the texts and explained their essence. After the meeting, Abdymanap learned from the media that Hizb ut-Tahrir had been designated a\u00a0terrorist organization in\u00a0Russia and banned. Abdymanap said he\u00a0never attended such meetings again. On\u00a028 March 2017 he\u00a0was arrested.<\/p>\n

Karimov became interested in\u00a0the activities of\u00a0Hizb ut-Tahrir at\u00a0the end of\u00a0the winter of\u00a02014. He\u00a0took part in\u00a0several meetings, at\u00a0one of\u00a0which he\u00a0was given a\u00a0copy of\u00a0the brochure, The Vision of\u00a0Hizb ut-Tahrir, to\u00a0read. In\u00a02015 Karimov did not respond to\u00a0an\u00a0invitation to\u00a0join the organization. When he\u00a0learned from the media about the arrest of\u00a0Hizb ut-Tahrir members he\u00a0stopped attending the meetings. Karimov and his family moved to\u00a0Penza region. On\u00a028 March 2017 he\u00a0was arrested. When his house was searched the copy of\u00a0the brochure, The Vision of\u00a0Hizb ut-Tahrir, was found.<\/p>\n

On\u00a02 April 2018 Moscow District Military Court sentenced Abdymanap and Karimov to\u00a0terms of\u00a010 and 11 years in\u00a0a\u00a0strict regime prison colony, respectively, on\u00a0charges of\u00a0participation in\u00a0the activities of\u00a0a\u00a0terrorist organization (Part 2 of\u00a0Article 205.5 of\u00a0the Russian Criminal Code).<\/p>\n

The court considered it\u00a0proven that Karimov and Abdymanap joined Hizb ut-Tahrir in\u00a0Moscow, were aware of\u00a0its terrorist orientation and their own membership of\u00a0the organization, and obeyed the organization\u2019s\u00a0discipline in\u00a0accordance with the group\u2019s\u00a0established hierarchy.<\/p>\n

Abdymanap and Karimov both pleaded guilty in\u00a0part. The investigators could not prove that the defendants had joined the organization. According to\u00a0the testimony of\u00a0the sole witness, the two men were considered to\u00a0be\u00a0only pupils. Both defendants stated they had ceased all participation in\u00a0Hizb ut-Tahrir\u2019s\u00a0activities in\u00a02015. Nevertheless, the court considered their involvement in\u00a0the organization continued up\u00a0until their arrests in\u00a0March 2017.<\/p>\n

Why Memorial considers the two individuals political prisoners<\/strong><\/p>\n

The convicted Muslims were guilty of\u00a0nothing more than being members of\u00a0a\u00a0civil society association. They were not charged with preparing terrorist attacks or\u00a0voicing terrorist threats. There is\u00a0not a\u00a0single piece of\u00a0evidence in\u00a0the case to\u00a0show that the defendants committed or\u00a0planned to\u00a0commit violence, still less actions that could be\u00a0called terrorist in\u00a0the accepted meaning of\u00a0the word.
\nMemorial considers the designation of\u00a0Hizb ut-Tahrir as\u00a0a\u00a0terrorist organization to\u00a0be\u00a0unlawful. The decision of\u00a0the Supreme Court, adopted in\u00a02003 at\u00a0a\u00a0closed session without the participation of\u00a0Hizb ut-Tahrir representatives, contained one paragraph of\u00a0three sentences dealing with the organization. The three sentences contain no\u00a0evidence of\u00a0terrorist activities.<\/p>\n

The designation of Hizb ut-Tahrir as \u2018terrorist\u2019 has made it possible to define all its activities, including meetings, tea-drinking sessions and prayers, as terrorist activities, and to consider the purchase of its literature, and the making of donations to help those with the same beliefs who have been arrested, as the financing of terrorism.<\/p>\n

It\u00a0should be\u00a0noted that Article 28 of\u00a0the Russian Constitution protects these actions of\u00a0believers. Article 28 guarantees everyone \u2018freedom of\u00a0conscience, freedom of\u00a0religion, including the right, individually or\u00a0in\u00a0community with others, to\u00a0profess any religion or\u00a0not to\u00a0profess any religion, to\u00a0freely choose, have and disseminate religious and other beliefs and to\u00a0act in\u00a0accordance with them.\u2019<\/p>\n

In\u00a0the years since the designation of\u00a0Hizb ut-Tahrir as\u00a0terrorist, hundreds of\u00a0Muslims have been convicted on\u00a0charges related to\u00a0their involvement in\u00a0the organization. With the passing of\u00a0each year, the courts have imposed ever longer sentences of\u00a0imprisonment on\u00a0the believers (up\u00a0to\u00a024 years in\u00a0a\u00a0strict regime prison colony). At\u00a0the present time, more than 300 people\u00a0are being prosecuted<\/a>\u00a0on\u00a0charges of\u00a0involvement in\u00a0Hizb ut-Tahrir.<\/p>\n

The \u2018solving\u2019 of\u00a0a\u00a0series of\u00a0cases related to\u00a0Hizb ut-Tahrir has been made extremely easy in\u00a0order to\u00a0enable the security services to\u00a0achieve maximum results with minimum effort. The security services have been granted the opportunity to\u00a0improve their statistics for solving crimes many times over (thereby demonstrating their own utility). They have manipulated public notions of\u00a0the terrorist threat and substituted the pretence of\u00a0a\u00a0struggle against terrorism for the real thing. At\u00a0the same time, these exaggerated notions about the terrorist threat have been used to\u00a0justify the adoption of\u00a0laws restricting the rights of\u00a0citizens. In\u00a0this way, we\u00a0see the pretence of\u00a0a\u00a0struggle against terrorism works to\u00a0strengthen the powers of\u00a0the authorities.<\/p>\n
