Who is\u00a0Nikolai Platoshkin and what is\u00a0he\u00a0accused of?<\/strong><\/p>\n

Nikolai Platoshkin, a\u00a0former diplomat who has a\u00a0PhD in\u00a0history, is\u00a0an\u00a0associate professor and head of\u00a0the department of\u00a0international relations and diplomacy at\u00a0the Moscow Humanities University. He\u00a0is\u00a0known to\u00a0the general public as\u00a0a\u00a0politician and civil society activist, as\u00a0well as\u00a0a\u00a0popular video blogger of\u00a0\u2018left-wing-patriotic\u2019 views and leader of\u00a0the movement\u00a0For A\u00a0New Socialism<\/em>.<\/p>\n

In\u00a02019 Platoshkin was a\u00a0candidate for the Communist Party of\u00a0the Russian Federation in\u00a0elections to\u00a0the 7th State Duma in\u00a0the 70th electoral district. He\u00a0came second in\u00a0the elections.<\/p>\n

On\u00a015 April 2020 Platoshkin published a\u00a0video on\u00a0his YouTube channel entitled \u2018Coronavirus. The latest news from the regions. Conference call of\u00a0the movement For New Socialism.\u2019 This video has been the pretext for the start of\u00a0his criminal prosecution.<\/p>\n

According to\u00a0investigators, Platoshkin publicly distributed information he\u00a0knew to\u00a0be\u00a0false about measures taken to\u00a0combat the coronavirus infection (Article 207.1 of\u00a0the Russian Criminal Code): \u2018He\u00a0reported information he\u00a0knew to\u00a0be\u00a0false about illegal measures taken by\u00a0the federal authorities and the Moscow city authorities to\u00a0compel people not to\u00a0leave their homes merely because hospitals were unable to\u00a0cope with the number of\u00a0visitors, not only because of\u00a0the new Coronavirus infection but also because of\u00a0other illnesses, and also information he\u00a0knew to\u00a0be\u00a0false about locking down the whole city, the innocent and the guilty, the sick and the healthy all where they were\u2026so that his allegations might cause discontent, a\u00a0message that might lead to\u00a0misconceived actions by\u00a0members of\u00a0the public and violations of\u00a0public order.\u2019<\/p>\n

In\u00a0addition, Platoshkin allegedly called on\u00a0citizens \u2018to\u00a0commit and participate in\u00a0riots under the guise of\u00a0protest rallies in\u00a0Moscow and other regions of\u00a0the Russian Federation\u2019 (Part 1.1 of\u00a0Article 212 of\u00a0the Russian Criminal Code).<\/p>\n

Since 4 June 2020 Nikolai Platoshkin has been under house arrest.<\/p>\n

Why does Memorial consider Platoshkin a\u00a0political prisoner?<\/strong><\/p>\n

Memorial Human Rights Centre analysed Platoshkin\u2019s\u00a0video, which is\u00a0the reason for his criminal prosecution, and found no\u00a0signs of\u00a0making preparations for riots or\u00a0incitement to\u00a0acts of\u00a0violence.<\/p>\n

Criticism of\u00a0actions by\u00a0the authorities is\u00a0an\u00a0inalienable right guaranteed under Russian and international law. Therefore we\u00a0support the position taken by\u00a0the international human rights organisation Amnesty International that has\u00a0recognised<\/a>\u00a0Platoshkin as\u00a0a\u00a0prisoner of\u00a0conscience.<\/p>\n

As\u00a0Memorial has already\u00a0noted<\/a>, \u2018in\u00a0March-April 2020, under the pretext of\u00a0combating the Coronavirus epidemic, there was an\u00a0unprecedented onslaught by\u00a0the federal centre and regional authorities on\u00a0rights and freedoms enshrined in\u00a0the Constitution of\u00a0the Russian Federation, together with the adoption of\u00a0a\u00a0whole series of\u00a0repressive legal norms and the introduction of\u00a0vague and potentially extremely dangerous innovations in\u00a0the Criminal Code, the Code of\u00a0Administrative Offences and regional codes of\u00a0administrative violations.\u2019 The new Article 207.1 of\u00a0the Criminal Code, under which one of\u00a0the charges against Platoshkin has been brought, has already been\u00a0widely used<\/a>\u00a0for repressive purposes. We\u00a0consider Article 207.1 one of\u00a0the articles of\u00a0the Criminal Code that has the least basis in\u00a0law. It\u00a0should be\u00a0immediately annulled.<\/p>\n

In\u00a0fact, the provisions of\u00a0Article 207.1 of\u00a0the Criminal Code do\u00a0not differ from those of\u00a0Parts 9\u201311 of\u00a0Article 13.15 of\u00a0the Code of\u00a0Administrative Offences (abusing the freedom of\u00a0mass media). The very existence of\u00a0this article creates an\u00a0extreme degree of\u00a0legal uncertainty and makes it\u00a0impossible for a\u00a0person prosecuted thereunder to\u00a0predict in\u00a0advance for what actions they are being prosecuted, which contradicts the objectives of\u00a0Russian criminal legislation.<\/p>\n

The political motive for the prosecution of\u00a0Nikolai Platoshkin seems obvious to\u00a0us\u00a0since he\u00a0is\u00a0a\u00a0well-known politician, leader of\u00a0an\u00a0opposition organization and a\u00a0popular video blogger whose YouTube channel had 476,000 subscribers at\u00a0the time of\u00a0his arrest (now the number of\u00a0subscribers exceeds half a\u00a0million). In\u00a0the months preceding the initiation of\u00a0the criminal case against him Platoshkin voiced with increasing clarity his opposition views and his negative attitude to\u00a0the government and the President of\u00a0the Russian Federation. He\u00a0urged his viewers to\u00a0vote against the amendments to\u00a0the Constitution and against giving President Putin the right to\u00a0serve two more terms in\u00a0office; he\u00a0also urged them to\u00a0attend rallies calling for Vladimir Putin\u2019s\u00a0resignation. Two days before his arrest, Platoshkin announced his intention to\u00a0run for the presidency in\u00a0the 2024 elections. If\u00a0he\u00a0is\u00a0convicted under Part 1.1 of\u00a0Article 212 of\u00a0the Criminal Code, he\u00a0will not be\u00a0able<\/a>\u00a0to\u00a0stand as\u00a0a\u00a0candidate in\u00a0elections at\u00a0least until 2030.<\/p>\n

In\u00a0accordance with\u00a0international guidelines<\/a>\u00a0defining the term \u2018political prisoner,\u2019 Memorial considers this criminal prosecution politically motivated and intended to\u00a0force Nikolai Platoshkin to\u00a0terminate his public activities. We\u00a0demand that the charges against the politician Nikolai Platoshkin be\u00a0dropped immediately and that he\u00a0be\u00a0released from house arrest. We\u00a0also call for the removal of\u00a0the unlawful Article 207.1 from the Criminal Code.<\/p>\n
