Memorial Human Rights Centre considers Kaluga resident Ivan Lyubshin a\u00a0political prisoner and believes the charges against him should be\u00a0dropped, Lyubshin himself immediately released, and his allegations of\u00a0torture impartially investigated.<\/strong><\/p>\n

Who is\u00a0Ivan Lyubshin and what has he\u00a0been charged with?<\/strong><\/p>\n

On\u00a031 October 2018 Ivan Lyubshin reposted on\u00a0his page on\u00a0the VKontakte social media site the news that 17-year-old anarchist Mikhail Zhlobitsky had blown himself up\u00a0in\u00a0the entrance hall of\u00a0the FSB building in\u00a0Arkhangelsk. He\u00a0added some comments of\u00a0his own about the deceased.<\/p>\n

These comments became grounds for his criminal prosecution. Almost a\u00a0year later, on\u00a014\u00a0October 2019, criminal proceedings were instituted against Lyubshin under Part 2\u00a0of\u00a0Article 205.2 of\u00a0the Criminal Code (public justification of\u00a0terrorism and advocacy of\u00a0terrorism committed using the Internet).<\/p>\n

On\u00a0the morning of\u00a015\u00a0October 2019, Lyubshin was detained at\u00a0a\u00a0bus stop by\u00a0FSB officers. According to\u00a0Lyubshin, the FSB officers put him in\u00a0a\u00a0car, handcuffed him and took him to\u00a0a\u00a0forest where they kicked him and used an\u00a0electroshock device on\u00a0him. They then took him to\u00a0the Investigative Committee for questioning. On\u00a017\u00a0October, the Kaluga district court placed him under house arrest.<\/p>\n

Subsequently, doctors recorded \u2018multiple bruises\u2019 on\u00a0Lyubshin\u2019s legs, arms, shoulder, ear, back and lower back. However, first the Kaluga prosecutor\u2019s office and then the federal Investigative Committee refused to\u00a0initiate criminal proceedings against the FSB officers for torture.<\/p>\n

On\u00a025 December 2019 Lyubshin was released under travel restrictions.<\/p>\n

On\u00a05 March 2020, the 2nd Western District Military Court found Lyubshin guilty of\u00a0committing a\u00a0crime under Part 2\u00a0of\u00a0Article 205.2 of\u00a0the Criminal Code and sentenced him to\u00a0five years two months in\u00a0a\u00a0general regime penal colony with a\u00a0subsequent ban on\u00a0working as\u00a0a\u00a0website administrator for two years.<\/p>\n

What is\u00a0wrong with Article 205.2 of\u00a0the Criminal Code?<\/strong><\/p>\n

Memorial noted in\u00a0its report \u2018Statements in\u00a0support of\u00a0terrorism\u2019 that Article 205.2 of\u00a0the Criminal Code has effectively replaced the partially decriminalized Article 282 of\u00a0the Criminal Code (incitement of\u00a0hatred or\u00a0enmity, as\u00a0well as\u00a0abasing human dignity) as\u00a0the main instrument for political motivated prosecution with regard to\u00a0statements made on\u00a0the Internet.<\/p>\n

In\u00a0particular, the report said, \u2018in many instances criminal prosecutions of\u00a0this kind are characterized by\u00a0a\u00a0formalistic approach and a\u00a0punishment markedly disproportionate to\u00a0the real danger [of\u00a0the incriminated act], and sometimes prosecution may be\u00a0retaliation for political views or\u00a0for social or\u00a0political activism.\u2019<\/p>\n

Why Lyubshin?<\/strong><\/p>\n

The selection of\u00a0Lyubshin as\u00a0a\u00a0victim of\u00a0criminal prosecution could have been influenced by\u00a0his opposition views, the fact that some of\u00a0his friends on\u00a0social media are opposition activists in\u00a0Kaluga and the fact that he\u00a0had previously been associated with an\u00a0Orthodox Church that is\u00a0an\u00a0alternative to\u00a0the Moscow Patriarchy.<\/p>\n

It\u00a0is\u00a0obvious that Lyubshin\u2019s prosecution is\u00a0connected with the fact that he\u00a0has long been under observation by\u00a0the security services. In\u00a02017\u00a0he was fined of\u00a0400,000 roubles under Part\u00a02 Article 282 of\u00a0the Criminal Code (incitement to\u00a0hatred or\u00a0enmity) and Part\u00a02 Article 354.1 of\u00a0the Criminal Code (rehabilitation of\u00a0Nazism using the media). In\u00a0addition, Lyubshin was charged under Point \u2018b\u2019 of\u00a0Part 3\u00a0of\u00a0Article 242 of\u00a0the Criminal Code (distribution of\u00a0pornography using the media) but was acquitted at\u00a0his trial.<\/p>\n

Why does Memorial consider Lyubshin a\u00a0political prisoner?<\/strong><\/p>\n

Lyubshin is\u00a0not accused of\u00a0inciting terrorist attacks or\u00a0other violent acts. His prosecution is\u00a0related solely to\u00a0a\u00a0few careless comments about a\u00a0news item on\u00a0his personal social media page that has a\u00a0very small audience. These comments did not contain explicit calls for violence and posed a\u00a0negligible public danger, if\u00a0any at\u00a0all. Moreover, Lyubshin had already deleted the comments by\u00a0the time the criminal case was initiated. His prosecution should be\u00a0seen in\u00a0the context of\u00a0the prosecutions of\u00a0members of\u00a0the political opposition, journalists and other writers on\u00a0public affairs and those who accidentally became involved in\u00a0the discussion of\u00a0the causes and nature of\u00a0the act, as\u00a0well as\u00a0the personality, of\u00a0Mikhail Zhlobitsky, who blew himself up\u00a0in\u00a0the FSB building in\u00a0Archangelsk.<\/p>\n

The information we\u00a0have suggests that, after Lyubshin\u2019s detention, he\u00a0was tortured, something which has become a\u00a0typical means of\u00a0interrogation in \u2018terrorist\u2019 cases investigated by\u00a0the FSB. For example, a\u00a0medical exam\u00a0recorded<\/a>\u00a0numerous bruises and contusions on\u00a0Lyubshin\u2019s body \u2018near his ear, on\u00a0his wrists, his right elbow, left shoulder, chest, ribs, lower back and right shin.\u2019<\/p>\n

Memorial Human Rights Centre, in\u00a0line with the\u00a0international guidelines<\/a>\u00a0defining the term \u2018political prisoner,\u2019 believes this criminal prosecution is\u00a0politically motivated. It\u00a0is\u00a0intended to\u00a0enforce a\u00a0cessation of\u00a0criticism of\u00a0government authority and the retention of\u00a0power by\u00a0those in\u00a0public office. It\u00a0is\u00a0being carried out because of\u00a0the views of\u00a0the person prosecuted, based on\u00a0his non-violent exercise of\u00a0freedom of\u00a0expression and information, and in\u00a0violation of\u00a0the right to\u00a0a\u00a0fair trial. The deprivation of\u00a0liberty imposed on\u00a0Ivan Lyubshin is\u00a0manifestly wrong in\u00a0terms of\u00a0the acts of\u00a0which he\u00a0is\u00a0accused, taking into account the combination of\u00a0the dubious character of\u00a0the prosecution, its disproportionate nature in\u00a0the light of\u00a0any potential danger to\u00a0the public, and the serious violations of\u00a0his rights.<\/p>\n
