Memorial Human Rights Centre considers Aleksandr Atamanov a\u00a0political prisoner, in\u00a0accordance with\u00a0international guidelines<\/a>\u00a0defining the term. We\u00a0consider the authorities prosecuted Atamanov as\u00a0part of\u00a0their anti-Ukrainian campaign. The alleged crime with which Atamanov was charged simply did not take place; the evidence was falsified. It\u00a0is\u00a0possible Atamanov was tortured. We\u00a0urge that the charges against Atamanov for an\u00a0offence under Part\u00a01.1 of\u00a0Article 282.2 of\u00a0the Russian Criminal Code, be\u00a0immediately dropped; that an\u00a0impartial investigation in\u00a0relation to\u00a0charges under Part 2\u00a0of\u00a0Article 228 of\u00a0the Russian Criminal Code, be\u00a0conducted; and that reports of\u00a0the use of\u00a0violence and threats against him be\u00a0investigated.<\/strong><\/p>\n

Who is\u00a0Aleksandr Atamanov and what are the charges against him?<\/strong><\/p>\n

Aleksandr Atamanov, a\u00a0freight handler and sportsman from Pyatigorsk, has been charged (under Part\u00a01.1 of\u00a0Article 282.2 of\u00a0the Russian Criminal Code) with recruiting others to\u00a0take part in\u00a0the activities of\u00a0an\u00a0extremist organisation; and acquiring and possessing large amounts of\u00a0drugs (under Part 2\u00a0of\u00a0Article 228 of\u00a0the Russian Criminal Code).<\/p>\n

According to\u00a0the investigators, on\u00a023\u00a0December 2018 Atamanov allegedly shouted slogans of\u00a0Right Sector, an\u00a0organisation banned and designated as\u00a0extremist in\u00a0Russia, on\u00a0a\u00a0street in\u00a0Pyatigorsk for an\u00a0hour, and also distributed leaflets and urged passers-by to\u00a0join the organisation.<\/p>\n

On\u00a021 March 2019 Atamanov was detained for petty hooliganism (under Article\u00a020.1 of\u00a0the Code of\u00a0Administrative Violations), allegedly because of\u00a0using swear words, and at\u00a0the same time, according to\u00a0investigators, drugs were found on\u00a0him. After he\u00a0had served a\u00a0jail term for the administrative offence, he\u00a0was detained for a\u00a0criminal offence, and since 25\u00a0March 2019\u00a0he has been held on\u00a0remand.<\/p>\n

Pyatigorsk town court is\u00a0hearing Atamanov\u2019s case and will soon hand down a\u00a0judgment.<\/p>\n

Why does Memorial consider Atamanov a\u00a0political prisoner?<\/strong><\/p>\n

The political motivation for the prosecution lies in\u00a0the position taken by\u00a0Russia regarding the armed conflict in\u00a0the east of\u00a0Ukraine. Russia denies that it\u00a0is\u00a0a\u00a0participant in\u00a0the conflict but takes a\u00a0clearly anti-Ukrainian position. This is\u00a0seen in\u00a0statements by\u00a0officials, in\u00a0propaganda, in\u00a0the assistance provided to\u00a0the separatist formations in\u00a0the east of\u00a0Ukraine, and in\u00a0the ban on\u00a0Ukrainian nationalist organisations. Since 2017\u00a0a campaign has been underway to\u00a0prosecute supporters of\u00a0Right Sector. Atamanov has been among the victims of\u00a0this campaign, although his links with the organisation have not been proved.<\/p>\n

It\u00a0is\u00a0probable that the prosecution was the result of\u00a0a\u00a0number of\u00a0factors: a\u00a0personal conflict, slander, and the desire of\u00a0law enforcement officers to\u00a0improve their statistics for combating extremist organisations. The charges of\u00a0hooliganism and drugs were probably used to\u00a0isolate Atamanov and put pressure on\u00a0him.<\/p>\n

The case materials show signs of\u00a0the falsification of\u00a0evidence\u00a0\u2014 for example, Atamanov\u2019s arrest in\u00a0improbable circumstances when key pieces of\u00a0evidence were discovered, and witnesses who were not independent of\u00a0the law enforcement officers and who may be\u00a0considered suspicious. There is\u00a0no\u00a0convincing evidence of\u00a0guilt.<\/p>\n

The charge of\u00a0recruiting for Right Sector is\u00a0itself unlawful, since the organisation was designated extremist on\u00a0the basis of\u00a0very weak arguments and in\u00a0gross violation of\u00a0fundamental legal procedures.<\/p>\n

During the proceedings against Atamanov there has possibly been a\u00a0violation of\u00a0the prohibition on\u00a0torture. Atamanov has stated that threats of\u00a0physical violence were made against him at\u00a0the time of\u00a0his arrest, and according to\u00a0Atamanov\u2019s wife, Atamanov was also the object of\u00a0violence and threats during the time he\u00a0has been held on\u00a0remand.<\/p>\n
