Memorial Human Rights Centre considers Aleksei Bessarabov and Vladimir Dudka political prisoners in\u00a0line with\u00a0international guidelines<\/a>\u00a0defining the term. We\u00a0believe the two men were criminally prosecuted because of\u00a0their professions (both were retired Ukrainian naval officers) and because they both had strong continuing links with Ukraine. The prosecution was based on\u00a0torture and the fabrication of\u00a0evidence of\u00a0a\u00a0non-existent offence in\u00a0violation of\u00a0the rights to\u00a0legal representation and a\u00a0fair trial. Memorial Human Rights Centre calls for the immediate release of\u00a0Bessarabov and Dudka.<\/strong><\/p>\n

Who are Vladimir Dudka and Aleksei Bessarabov<\/strong><\/p>\n

Aleksei Bessarabov is\u00a0a\u00a0journalist and Vladimir Dudka is\u00a0an\u00a0engineer with the Russian Emergencies Ministry, both residents of\u00a0Sevastopol and former Ukrainian naval officers who retired several years before Russia annexed the Crimea.<\/p>\n

On\u00a09 November 2016 the two were detained by\u00a0FSB officers. Both were charged with preparing acts of\u00a0sabotage in\u00a0Sevastopol on\u00a0the instructions of\u00a0Ukraine.<\/p>\n

On\u00a04 April 2019 Sevastopol City Court sentenced Bessarabov and Dudka to\u00a014\u00a0years in\u00a0a\u00a0strict-regime prison colony and fines of\u00a0300,000 roubles and 350,000\u00a0roubles, respectively, for offences under Article\u00a030, Section\u00a01, of\u00a0the Russian Criminal Code in\u00a0association with Article 281, Section\u00a02, Part\u00a0a, of\u00a0the Russian Criminal Code (preparing acts of\u00a0sabotage as\u00a0part of\u00a0an\u00a0organised group) and Article 222.1, Section\u00a03, of\u00a0the Russian Criminal Code (illegal possession of\u00a0improvised explosive devices as\u00a0part of\u00a0an\u00a0organised group).<\/p>\n

The charges<\/strong><\/p>\n

According to\u00a0the FSB, at\u00a0the behest of\u00a0Ukrainian military intelligence Bessarabov and Dudka made preparations to\u00a0blow up\u00a0TV and radio transmitters and fuel warehouses belonging to\u00a0the Black Sea Fleet in\u00a0Sevastopol.<\/p>\n

Why Memorial Human Rights Centre considers Bessarabov and Dudka political prisoners<\/strong><\/p>\n

The authorities did not allow the suspects to\u00a0see either their family or\u00a0lawyers for more than a\u00a0week after they were arrested.<\/p>\n

Subsequently, they related in\u00a0detail how during that time FSB officers tortured them with electric shocks and forced them to\u00a0incriminate themselves in\u00a0front of\u00a0a\u00a0video camera.<\/p>\n

The main federal\u00a0TV channels\u00a0used<\/a>\u00a0cuts from these \u2018video confessions\u2019 as\u00a0proof of\u00a0the crimes of\u00a0the \u2018Kiev Junta.\u2019 The FSB was subsequently forced to\u00a0withdraw the charges laid in\u00a0many similar cases in\u00a0Crimea that were accompanied by\u00a0such video confessions (see, for example, the cases of\u00a0Vladimir Prisich<\/a>\u00a0and\u00a0Redvan Suleimanov<\/a>). It\u00a0is\u00a0therefore impossible to\u00a0consider them as\u00a0confirmation of\u00a0the guilt of\u00a0the defendants.<\/p>\n

In\u00a0our opinion, the FSB failed to\u00a0present significant evidence of\u00a0the alleged offences. For example, the explosive devices \u2018found\u2019 in\u00a0a\u00a0hidden cache bear no\u00a0traces of\u00a0the DNA of\u00a0the defendants.<\/p>\n

Despite the fact that the two men were under video surveillance and their phones were tapped, the authorities were unable to\u00a0catch them \u2018red-handed.\u2019 The evidence in\u00a0the case contains no\u00a0video or\u00a0audio recordings that even tangentially confirm the preparation of\u00a0acts of\u00a0sabotage.<\/p>\n

There are also strong grounds to\u00a0suggest that the correspondence on\u00a0the Viber messenger app cited as\u00a0evidence was fabricated, and the special phones, allegedly used to\u00a0conduct this correspondence, were planted.<\/p>\n

We\u00a0believe that the Russian authorities fabricated the case against Bessarabov and Dudka for the purpose of\u00a0propaganda as\u00a0part of\u00a0a\u00a0long-term campaign to\u00a0depict Ukraine and its citizens as\u00a0enemies.<\/p>\n

Recognition of\u00a0an\u00a0individual as\u00a0a\u00a0political prisoner, or\u00a0of\u00a0a\u00a0prosecution as\u00a0politically motivated, does not imply Memorial Human Rights Centre shares or\u00a0approves the individual\u2019s views, statements or\u00a0actions.<\/em><\/p>\n
